The provincial Court of Appeal

The Provincial Court of Asturias has eight divisions and 28 judges, and two of those divisions sit outside the capital, in Gijón. An appeal from there is not heard in Asturias city.

Companies and the commercial registry

Asturias has its own commercial registry, the Registro Mercantil y de Bienes Muebles de Asturias, at C/ Aller, 4 - bajo, Edif. Plaza Montecerrao. Incorporating, changing directors or winding up a company is filed there.

Asturias has no court specialising in unfair mortgage terms: a claim over a floor clause or mortgage costs goes to the ordinary civil division that would hear any other civil case, and shares its list.

Before filing a dismissal claim

Before suing over a dismissal you must attempt conciliation, and in Asturias that is done at the Unidad de Mediacion, Arbitraje y Conciliacion (UMAC), run by the Servicio de Relaciones Laborales, Direccion General de Empleo y Asuntos Laborales, Consejeria de Ciencia, Industria y Empleo del Principado de Asturias (Decreto 49/2025, art. 21: le corresponde la gestion de las competencias transferidas en materia de mediacion, arbitraje y conciliacion). Papeleta de conciliacion (procedimiento ARBI0011T01, Solicitud de conciliacion administrativa previa a la via judicial laboral). Presencial en las Oficinas del Servicio de Atencion al Ciudadano y en las Oficinas de Asistencia en materia de Registro del Principado de Asturias, o telematica en el Registro Electronico del Principado de Asturias o en el Registro Electronico General de la AGE; las personas juridicas estan obligadas a relacionarse por medios electronicos. Plazo de 20 dias habiles desde la fecha de efectos del despido o de la notificacion de la sancion, y de un ano en reclamaciones de cantidad o de derechos. La autoridad laboral cita a las partes al acto de conciliacion dentro de los 15 dias habiles siguientes y la presentacion de la papeleta suspende el plazo de caducidad.
