Legal basis and things to bear in mind
- Legal framework: arts. 1445-1500 CC (sale) plus arts. 1474-1500 CC (warranty against defects) plus RGV art. 32 (change of ownership within 30 days) plus ITP-AJD (RDLeg 1/1993) plus the official valuation tables.
- ITP 4 % as a general rule (varying by CCAA: 4 % in many, 6-8 % in others). Taxable base: the HIGHER of the declared price and the official value set by Hacienda. Hacienda may check values and raise the base if you declare an abnormally low price.
- Deadline for the DGT change of ownership: 30 days from signature (art. 32 RGV). If it is not done, the seller remains liable for any fines. DGT fee: 55,70 € (modelo 7).
- Warranty against hidden defects (art. 1484 CC): the seller is liable for non-apparent defects for 6 months from delivery (art. 1490 CC). A 'sold as seen' clause does NOT release the seller from liability for non-apparent defects in a sale between private individuals.
- If the seller is a PROFESSIONAL and the buyer a CONSUMER: the TRLGDCU applies, with a 3-year legal guarantee (Ley 7/1996, as amended). In those cases the contract and the guarantee are different.
- DGT encumbrances: seizures, retention-of-title clauses and unpaid fines PREVENT the change of ownership. Always check before signing (a DGT report on the vehicle).
- Expired ITV: the vehicle cannot legally be driven. Agree who will put it through the test, or adjust the price.
- IVTM (road tax): payable by whoever owns the vehicle on 1 January. After a sale it is usually apportioned between the parties.
- Natural connections: cambio_titularidad_vehiculo (DGT), recurso_multa_dgt (if you want to challenge a fine), notificacion_venta_dgt (advance notice of the sale).
- Important: vehicles over 25 years old (classics) may benefit from a special regime with ITP reductions in some CCAA.
