Legal basis and things to bear in mind
- The DGSFP is free: you do not pay any tasa (official fee) to the body. Our 90 € cover the technical drafting and the submission.
- The DGSFP decision is NOT binding on the insurer, but its evidential value in a civil claim is very high: if the DGSFP recommends paying and the insurer does not, the court treats it as a precedent.
- Remember art. 20 LCS: if the insurer does not pay within 3 months of the claim, it owes the legal interest increased by 50 %; after 2 years, a minimum of 20 % per year.
- Deadline to complain to the DGSFP: 1 year from the date of submission to the insurer's SAC.
