Legal basis and things to bear in mind
- Legal deadline: 3 calendar days from the effective termination. Late deregistrations are punishable (art. 22.3 LISOS) and keep generating contributions until they are notified.
- After the deregistration, the certificado de empresa (company certificate) must be given to the worker so they can claim contributory unemployment benefit if entitled.
- Exceptions to the deadline: death and force majeure allow retroactivity without penalty, provided documentation is submitted.
- If the dismissal is unfair, remember to calculate and pay the severance of 33 days per year (45 before Feb 2012) capped at 24 months' pay.
