Legal basis and things to bear in mind
- Legal deadline: 6 calendar days from the effective termination (art. 32.3.2.º RD 84/1996). Late bajas are subject to penalties (art. 22.3 LISOS) and continue to generate contributions until they are notified.
- After the baja, the company certificate must be delivered to the worker so they can apply for contributory unemployment benefits if they are entitled to them.
- Exceptions to the deadline: death and force majeure allow retroactivity without penalty by providing supporting documentation.
- If the dismissal is unfair (despido improcedente), remember to calculate and pay the compensation of 33 days per year (45 before February 2012) with a cap of 24 monthly payments.
