Legal basis and things to bear in mind
- FIRST THE ENVIRONMENTAL, THEN THE MUNICIPAL. The environmental procedure is prior to the declaración responsable or the licence from the Ayuntamiento, and until it is resolved, the necessary licences for the operation of the activity cannot be granted.
- THE CLASSIFICATION IS NOT OPEN TO DEBATE: each regional law has an annex that states, by CNAE code and threshold, whether the activity requires an integrated environmental authorisation, an impact assessment, an environmental verification, or a declaración responsable ambiental. What we do here is read that annex, not estimate.
- IT IS SIGNED BY A TECHNICIAN IN ADDITION TO THE HOLDER. The declaración responsable ambiental is not a form that the interested party fills out alone: the technical annex is signed by a competent technician. That cost is separate and is stated upfront.
- IF THE PROPERTY IS A DWELLING, the order changes: first of all, you must request the certificate of urban compatibility, because planning regulations usually reserve residential use and relegate annoying activities to industrial or rustic land. Spending money on the technical report before having that certificate is a waste of money.
- CANTABRIA, current framework: Ley de Cantabria 9/2026, of 23 July, on Environmental Control, in force since 29-08-2026, which REPEALS Ley 17/2006 on Integrated Environmental Control.
