Legal basis and things to bear in mind

  • If you sell at a loss and buy homogeneous securities within the two months before or after (one year if they are not listed on a regulated market), that loss cannot be used that year: it is taken into account when you sell the securities you bought back.
  • Investment losses first offset the year's gains; any excess offsets up to 25 % of the positive balance of dividends and interest, and the rest over the following four years. After that period they are lost.
  • Trading with your own money is taxed as a capital gain or loss in the savings base, including CFDs, forex, options and futures, even if you trade every day.
  • What you are paid by a prop firm is not an investment gain: it is taxed as business income in the general base, which usually costs more than the savings base.
  • Trades with a foreign broker do not usually appear in the tax data for your Renta return and that broker does not withhold Spanish tax: you still have to declare them. Tax withheld abroad on your dividends is deducted in Spain, up to a limit.
  • If at 31 December you held more than 50.000 euros in securities or accounts with institutions outside Spain, you may have to file Modelo 720. We check this against your statements.
  • If you have already filed your Renta return without these trades, the report is used to correct it: from the 2024 Renta onwards, with an autoliquidación rectificativa (corrective self-assessment), whether you owe more or are due a refund; for 2023 and earlier, with a supplementary return or a request for rectification.
