Which documents do you need?
- •Receipts for every transfer, Bizum or card charge made to the scam (or the statement showing them).
- •Screenshots of the conversations with the person who dealt with you and of the platform (dashboard, balance, website, advert).
- •If you paid in cryptocurrency: the transfer history of the exchange or of your wallet with the destination address and the hash.
- •If you have already reported it: a copy of the police report. If you have already complained to the bank in writing: your letter and the reply.
Legal basis and things to bear in mind
- Nobody can guarantee that you will get the money back, and on a cryptocurrency network there is no button to undo a transfer. What we do is claim against whoever can be held liable (your bank and the firm that received the funds) and leave the evidence ready for the investigation. The receiving firm decides whether to freeze; a binding freeze is ordered by the court following the police report.
- Beware of the second scam: if someone contacts you promising to recover what you lost in exchange for an upfront payment (so-called hackers, foreign law firms, fake police officers or fake officials of a public body), it is another fraud. Managora will never ask you for more money than the published price, nor for cryptocurrency.
- If any transaction was made without your authorisation, report it to your bank without delay: the right to a refund is lost if more than 13 months pass from the debit. If you made the payments yourself after being deceived, the route is different and depends on each case.
- Since 9 October 2025 your bank must check, before you authorise a transfer in euros, whether the payee's name matches the account holder. If it did not offer you that service or the check failed, it is liable to you; if it warned you that the name did not match and you made the transfer anyway, it is not liable on that ground.
- Since 1 July 2026, providing crypto-asset services in Spain requires authorisation from the CNMV or a passport from another EU Member State. If the platform does not have one, the CNMV does not process complaints against it: the report serves to put it on record so that the CNMV can warn the public.
- A loss from a scam can be taken to your Renta return, in the general tax base and not the savings base, but the year depends on the case: if the fraudster is unknown, the year of the scam, provided you can prove it; if the fraudster is identified, when your claim against them meets the requirements to be treated as lost (for example, one year after court enforcement of the claim begins without payment: a police report is not enough). We tell you in writing.
- If your bank rejects the complaint or does not reply, the next step is the Banco de España; if the money went through an authorised exchange, the CNMV. If there are grounds to sue your bank or the holder of the destination account, we quote for it separately. Managora does not handle private criminal prosecutions (querellas) or criminal defence.
