Legal basis and things to bear in mind

  • THE MYTH TO KILL IN THE FIRST SENTENCE: for an activity licence, silence means REFUSAL. It is not true that if the Ayuntamiento does not reply within three months the licence is yours. Waiting does not give it to you, it takes it away.
  • TWO BRANCHES, AND THEY MUST BE SEPARATED. (a) LEGAL refusal (use, disproportionate requirement, misapplication of the rules, silence): we handle the appeal on our own, with no technician. (b) TECHNICAL refusal (the project falls short): the project has to be corrected, and that is signed by a chartered technician. The client is told BEFORE being charged.
  • THE CORRECTIVE PROJECT IS COMPULSORY, NOT OPTIONAL. What is optional is who signs it: the client supplies it or we arrange it. The client is never sent off to find someone on their own.
  • SOMETIMES APPEALING IS NOT THE RIGHT MOVE: if the defect can be cured, filing again properly often opens the doors sooner than fighting the decision. The client must be told this even if the appeal earns us a bigger fee.
  • It chains with certificado_silencio_administrativo (to document the silence) and with reclamacion_unidad_mercado_operador (if the requirement is disproportionate). It does not duplicate them.
  • Verified legal framework: Ley 39/2015 arts. 24.1 para. 2, 24.4, 123 and 124; TRLSRU (RDLeg 7/2015) art. 11.3 and 11.4.b; LJCA arts. 25.1, 29 and 46.1.
