Legal basis and things to bear in mind

  • OEPM tasa (official fee) 2026: 1 class 144,58 € (122,89 € electronic); each additional class 93,68 € (79,63 € electronic).
  • Validity: 10 years from the filing date, renewable indefinitely (art. 31 LM).
  • Revocation for non-use: if after 5 years the trademark is not effectively used (art. 39 LM).
  • Absolute prohibitions (art. 5 LM): lack of distinctive character, official signs, public order, designations of origin.
  • Relative prohibitions (art. 6 LM): the OEPM does not examine them on its own initiative except for well-known marks (art. 8 LM); they are invoked by third parties through opposition in the BOPI.
  • Convenio de París: 6-month priority from the first application in another country (art. 14 LM).
  • Recommendation: if you will operate in >1 EU country or have 3+ classes, the EU EUIPO trademark is usually more efficient (~850 € for up to 3 classes, a single application for all 27 States).
