Legal basis and things to bear in mind

  • OEPM tasa (official fee) 2026: 1 design 78,89 € paper / 67,06 € electronic (-15 %). Each additional design in a multiple design 19,82 € paper / 16,85 € electronic.
  • Validity: 5 years initially, renewable for 5-year periods up to a maximum of 25 years (4 renewals).
  • Multiple design: up to 50 designs per application, all of the same Locarno class (art. 22 LDI).
  • Grace period: 12 months from disclosure by the designer themselves (art. 10 LDI). After that period, the design may have lost its novelty.
  • Deferment of publication: up to 30 months, keeping the design secret before launch (art. 32 LDI).
  • Convenio de París (Paris Convention): 6-month priority from the first application in another country.
  • The OEPM does NOT examine novelty or individual character on its own initiative. Nullity may be requested afterwards by third parties (art. 65 LDI).
  • Recommendation: if you are going to operate in more than 1 EU country or have a large multiple design, the Diseño Comunitario Registrado (Registered Community Design) (EUIPO) is usually more efficient (one application for 27 States).
