Legal basis and things to bear in mind

  • OEPM tasa (official fee) 2026 application: 143,07 € on paper / 121,61 € electronically (-15 %). Increasing annuities from the 3rd year (~23-125 €/year).
  • Validity: 10 years from the filing date. NOT renewable (art. 148 LP).
  • Grace period: 6 months from disclosure by the inventor themselves (art. 145 + 7 LP).
  • Convenio de París (Paris Convention): 12-month priority from the first application in another country (NB: different from the 6 months for a trade mark/design).
  • Excluded from the utility model (art. 137.2 LP): processes, therapeutic/surgical methods, biological material, chemical/pharmaceutical substances. These can only be protected as a full PATENT.
  • The OEPM does NOT examine novelty or inventive step of its own motion. Nullity can be requested afterwards by third parties (art. 149 LP).
  • Difference from a patent: lower inventive step required, no substantive examination, faster and cheaper, but validity 10 years (vs 20 for a patent).
