Legal basis and things to bear in mind

  • OEPM renewal tasa according to the current scale published by the OEPM: first class 174,18 € on paper / 148,06 € with electronic filing and payment (-15 %); each successive class 116,95 € on paper / 99,39 € with electronic filing and payment. We confirm the applicable amount for your case before you pay anything.
  • Surcharge for renewing within the grace period AFTER expiry: 25 % during the first 3 months and 50 % during the following 3 months. It is not a flat 25 % during the 6 months.
  • After 6 months post-expiry, the trademark expires (art. 55 LM): it is not renewable, a new application must be submitted.
  • The renewal is granted for a further 10 years from the previous expiry date. Indefinitely renewable.
  • In the renewal, NO expansion of classes or products/services is allowed. A reduction is permitted.
  • Revocation for non-use: even if renewed, if there is no effective use for 5 consecutive years, revocation can be requested by third parties (art. 39 LM).
