Legal basis and things to bear in mind
- The deadline is set in the notice itself and runs from the day after you received it: for an information request it cannot be less than 10 working days, and for objecting to a proposed assessment it is 10 to 15 working days. If you do not reply, the procedure carries on and is decided solely on the data Hacienda holds.
- Once you have received a request, voluntary disclosure with a late-filing surcharge is no longer available: that surcharge only applies to those who file without a prior request, and any AEAT action notified to you aimed at checking or assessing that tax debt counts as one.
- Exchanges and custodians resident or established in Spain report your balances (Modelo 172) and your transactions (Modelo 173) to the AEAT from the 2023 tax year. If you held more than 50.000 euros in crypto held in custody outside Spain on 31 December, the return was yours to file: Modelo 721.
- Your acquisition cost is proven with your purchase history, including purchases from years before the one under review. What is not evidenced is not deducted, and the gain comes out higher than it really is.
- Hacienda can review any tax year that is not time-barred: the period is 4 years, counted from the day after the filing deadline for that year's return.
- If you later receive an assessment (liquidación), it is appealed by way of reposición or before the TEAR within 1 month; a penalty follows its own procedure. We handle both through their own services.
