INSS pension supplements and claims

What is new, and the law that applies

  • Article 60 of the Ley General de la Seguridad Social as worded by Real Decreto-ley 3/2021, of 2 February: replaces the old maternity supplement for demographic contribution (pensions from 2016 to 3 February 2021) with the gender gap reduction supplement, in force since 4 February 2021.
  • CJEU ruling of 15 May 2025 (case C-623/23): declares it discriminatory based on sex, and contrary to Directive 79/7/EEC, to exclude or hinder men from accessing the gender gap supplement.
  • Supreme Court, Plenary of the Social Chamber, ruling of 25 June 2025 (ECLI:ES:TS:2025:3173), disseminated by CGPJ note of 9 July 2025: the gender gap supplement must be paid to men under the same conditions as women.
  • Supreme Court ruling 418/2025, of 9 May: the old maternity supplement can be received simultaneously by the father and the mother if both meet the requirements.
  • The Supreme Court sets compensation of €1,800 for men who were denied the old maternity supplement for demographic contribution by the INSS (denials subsequent to the CJEU ruling of 12 December 2019, case C-450/18) and who had to go to the social courts. This compensation refers to that supplement (2016-2021), not the current gender gap supplement.
  • 2026 amount revalued by 2.7%: €36.90 per month per son or daughter (confirm the current amount on the service page).

What is the gender gap reduction supplement?

The gender gap reduction supplement is an amount added each month to contributory retirement, permanent disability and widowhood pensions, for each son or daughter. It is regulated in article 60 of the Ley General de la Seguridad Social (the Spanish General Social Security Act) and is recognised and paid by the INSS alongside the pension.

It replaces the old maternity supplement for demographic contribution, which applied to pensions generated between 2016 and 3 February 2021. Since 4 February 2021 (Real Decreto-ley 3/2021), the new gender gap supplement has been in force.

In 2026 the amount is €36.90 per month per son or daughter, with a maximum of 4 (up to €147.60 per month), and it is paid in 14 monthly instalments. You can see the updated amount and check your case on the Managora service page.

Can men claim the maternity supplement?

In its original wording, the law recognised the supplement for women with 1 or more children almost automatically, whereas for men it only applied if they could prove a detriment to their contribution career linked to the birth or care of the children.

The Court of Justice of the European Union, in its ruling of 15 May 2025 (case C-623/23), declared that this difference is direct discrimination based on sex, contrary to Directive 79/7/EEC. The Supreme Court, sitting in plenary session (ruling of 25 June 2025), has confirmed that the supplement must be paid to men under the same conditions as women.

Therefore, if you are a man and the INSS denied you the supplement, or you never applied for it, you can request and claim it. It is worth distinguishing 2 situations. For the old maternity supplement for demographic contribution (pensions generated between 2016 and 3 February 2021), the Supreme Court has set compensation of €1,800 for men who were denied the supplement by the INSS after the European ruling of 12 December 2019 (case C-450/18) and who had to go to the social courts. For the current gender gap supplement (since 4 February 2021), the appropriate action is to recognise the supplement for men under the same conditions as women. What is the prior claim to the INSS and when is it mandatory?

The prior claim is the written document with which you ask the INSS, the TGSS or the SEPE to review a decision before going to court. It is regulated by article 71 of the Ley Reguladora de la Jurisdicción Social (the Spanish Social Jurisdiction Act) and is a mandatory requirement: without it, the Social Court will dismiss the lawsuit.

You have 30 working days from the notification to file it. The entity has 45 days to reply; if it does not do so, it is considered denied by silence. From then on, you have 30 working days to file the lawsuit.

It applies to the denial of benefits: retirement, permanent disability, widowhood, unemployment or the gender gap supplement itself. Do not confuse it with the appeal to a higher instance (recurso de alzada), which is for collection and sanctioning acts (see the comparison). How do you request a refund of undue payments from the TGSS?

If you have paid the Seguridad Social (the Spanish social security system) more than you owed (for example, due to excess contributions in a situation of multiple activities, duplicate quotas or a calculation error), you have the right to have the TGSS refund the overpaid amount.

The application is filed using the modelo TC 13/1 at the Provincial Directorate of the TGSS or at its electronic headquarters. The right expires 4 years from the day following the undue payment, and the TGSS must resolve it within 6 months. The refund is paid with the applicable late payment interest and can be offset against outstanding debts with the Seguridad Social.

    Gather the decision and calculate the deadline(30 working days)

    Locate the decision from the INSS, the TGSS or the SEPE that you want to challenge and check the notification date. The deadline counts from the following day.

    Draft the prior claim

    A written document addressed to the Provincial Directorate that issued the act, with your details, the decision you are challenging, the facts, the legal grounds and the supporting documentation.

    File the document

    At the electronic headquarters of the Seguridad Social or the SEPE (with a digital certificate or Cl@ve, the Spanish electronic identity system), at an in-person registry or by administrative mail. Always keep the proof of filing.

    Wait for the INSS response(45 days)

    The entity must reply explicitly. If it does not do so within the deadline, the claim is considered denied by administrative silence.

    If denied, file the lawsuit(30 working days)

A worked example

A retirement pensioner with 3 children who is recognised as entitled to the gender gap reduction supplement in 2026.

Can men claim the maternity or gender gap supplement?

Yes. Following the CJEU ruling of 15 May 2025 and the Supreme Court ruling of 25 June 2025, the gender gap supplement must be recognised for men under the same conditions as women. If you were denied it or did not apply for it, you can request and claim it.

How much time do I have to file the prior claim?

30 working days from the day following the notification of the decision by the INSS, the TGSS or the SEPE. If you let the deadline pass, you may lose the right to sue, so it is advisable to act as soon as you receive the decision.

What happens if the INSS does not reply to my prior claim?

After 45 days without a response, it is considered denied by administrative silence. From that moment you have 30 working days to file the lawsuit before the Social Court.

How many years back can I claim overpaid quotas?

The refund of undue payments expires after 4 years, counted from the day following the payment. It is requested from the TGSS using the modelo TC 13/1 and the Treasury must resolve it within 6 months.

Do I need a lawyer for the prior claim?

Not to file it: it is an administrative procedure before the INSS. Managora prepares the document and files it for you, and the judicial phase is only initiated if the case reaches the Social Court.

Will I receive arrears if the supplement is recognised?

Yes. Generally, the supplement is recognised with economic effects of up to 3 months prior to the application date (art. 53 LGSS). In claims by men for discrimination, the CJEU and the Supreme Court allow the effects to be backdated to the date of the event causing the pension, which means more arrears. Furthermore, for the old maternity supplement for demographic contribution (2016-2021), anyone who had to go to court after a denial may be entitled to the €1,800 compensation set by the Supreme Court.
