- 1Answer the questions (around 10 minutes), give us the deadline set by the public body and upload the documents.
- 2If any answer shows that the SGR cannot guarantee you or that the public body does not require a guarantee, we tell you before you pay.
- 3Payment according to the amount of the guarantee: 249 € up to 50.000 €, 399 € from 50.001 to 300.000 € and 599 € above 300.000 € (VAT included).

Which documents do you need?
- •Document requiring the guarantee: the tender request and the tender specifications (pliego), the deferral decision (or the debt you are going to defer), the grant decision and its rules, or the public body's letter.
- •If you are a company: annual accounts and corporate income tax returns (Modelo 200) for the last two financial years.
- •If you are self-employed: income tax return (Modelo 100) and annual VAT summary (Modelo 390) for the last two financial years.
- •If you are a company: deed of incorporation and deed of appointment or power of attorney of whoever signs.
- •DNI or NIE of whoever signs, both sides.
Legal basis and things to bear in mind
- The SGR assesses and decides each guarantee case by case: we cannot guarantee that it will be granted or on what terms. To be guaranteed, you must become a socio partícipe (participating member) of the SGR by subscribing shares in its capital, and each SGR only guarantees members with premises within its territory.
- The SGR's costs are separate from our price and you pay them to the SGR: an assessment fee, a guarantee fee, usually annual for as long as the guarantee is live (some SGRs charge it once, upfront), and a capital contribution, which is refundable. Each SGR sets its own percentages and tells you before you sign.
- Public tenders: a provisional guarantee is only required if the tender specifications justify it (at most 3 % of the base tender budget excluding VAT, and never in the simplified open procedure), and the guarantee is handed to the contracting authority. The final guarantee is as a general rule 5 % of the price offered excluding VAT and must be evidenced within 10 working days of the request (7 in the simplified open procedure). If it is not provided in time, the contract is not awarded and a penalty of 3 % of the base tender budget excluding VAT is charged. It is returned once the contract's guarantee period ends, if the contract has been properly performed and no liabilities remain.
- Hacienda: above 50.000 € the guarantee it asks for first is a guarantee from a bank or an SGR (or a surety insurance policy). If the whole deferred debt is guaranteed this way, statutory interest (interés legal) is charged instead of late-payment interest. The guarantee covers the debt, the interest and a further 25 % (5 % if the debt is already in the enforcement period, with its surcharge), must run for at least 6 months beyond the last instalment and is released once everything is paid.
- Seguridad Social: its rules name guarantees from banks and credit cooperatives and do not mention SGRs. Before requesting the guarantee we check that the Tesorería (Social Security Treasury) will accept the SGR's guarantee in your case; if it will not, we tell you and look at the alternative with you on the chat.
- Grants: the guarantee for an advance is required by the grant rules. It covers the advance plus the percentage they set (at most 20 %) and is lodged with the Caja General de Depósitos or the equivalent fund of the authority granting it. If cancellation of the guarantee is delayed for reasons beyond your control, the authority reimburses the cost of keeping it.
