Legal basis and things to bear in mind

  • Framework in force: Ley 24/2013 (Electricity Sector Act) + RD 88/2026 of 11 February, the general regulation on the supply, retail and aggregation of electricity (in force since 12-02-2026; its arts. 6, 13, 28, 29, 30, 43, 44 and 45 since 12-06-2026). That regulation repealed arts. 79 to 86, 88, 89, 91 and 98 of RD 1955/2000 and the whole of RD 1435/2002.
  • The switch is FREE and your supply is never cut off: art. 44.1.k) of Ley 24/2013 and art. 18.3 of RD 88/2026, which expressly bans charging any switching fee in the 2.0TD tariff segment.
  • The deadline is 10 working days from signature, not 21 days. The 21 days in art. 19.6 are the distributor's deadline to send the meter reading to the outgoing supplier, which is a different thing.
  • Lock-in: an individual on 2.0TD may terminate at any time at no charge, except for a fixed-price contract before its first annual renewal; the penalty is capped at 5% of the estimated energy still to be supplied and the burden of proving the loss always falls on the supplier (art. 28.3).
  • An unpaid bill does not block the switch. The only rule is that a reference supplier may refuse to sign a PVPC contract if the previous contract was terminated for non-payment, and only where the debt is certain, due and enforceable (art. 28.8).
  • If the switch went through without your consent, nothing may be charged to you for that supply or for the associated services (art. 18.7).
  • The outgoing supplier has a maximum of 42 days to send you the final settlement of the account (art. 44.1.ñ of Ley 24/2013 and art. 13.v of the regulation).
  • The physical distribution company does NOT change.
