Legal basis and things to bear in mind
- Legal deadline: 10 working days from signing (art. 16.1 ET and art. 2.1 RD 1424/2002). Past the deadline it is a minor infringement under LISOS art. 7.2 (fine of 70-750 €).
- 2022 Labour Reform (RDL 32/2021): temporary contracts due to production circumstances are only allowed for OCCASIONAL and UNFORESEEABLE causes, or foreseeable ones ≤90 days/year. Replacements require identifying the person being replaced. Chaining temporary contracts for >18 months within 24 months turns the contract into a permanent one (art. 15.5 ET).
- Reporting to the SEPE does NOT replace registration with the TGSS (Social Security General Treasury): you must register the worker beforehand (use alta_empleado).
- If the contract is amended (annex, extension, conversion to permanent), the change must also be reported to the SEPE.
