Import declaration for cultural goods (art and antiques)
Import declaration for cultural goods (art and antiques) is filed with Ministerio de Cultura, Subdirección General de Registros y Documentación del Patrimonio Histórico (sede electrónica). With Managora you do it 100% online: you answer a few questions, sign a digital mandato (power of representation) and we draft, sign and file your application for you. What we charge you: €149. Official tasa (government fee): No official fee. The import declaration to the Ministerio de Cultura is free. If the item came from outside the EU, customs duties and import VAT are not part of this service: customs assesses them on the import declaration and you pay them.
We prepare and file with the Ministerio de Cultura the import declaration for your artwork, antique or other cultural item, which can only be filed within 3 months of its arrival in Spain. That way, for 10 years, the permit to export it again cannot be refused and you will not pay the export tax. We review your documents, draft the description of the item and file it on your behalf under the mandate you sign; the customs declaration is not part of this service.

- 6Forward us any request from the Ministry as soon as you receive it: we answer it in time. Keep the filing receipt and the Ministry's reply, if you receive one, with the item's papers: they are the documents you will rely on when you apply for the permit to export it.
Which documents do you need?
- •If the item came from outside the European Union: the customs import declaration (H1, formerly the DUA).
- •If it came from another European Union country: proof of the date it entered Spain, such as the transport invoice.
- •Proof of ownership: the purchase invoice or, if you inherited it or it was given to you, the document showing this.
- •Photographs of the item, if you have them (they help to identify it).
- •Mandate of representation: we prepare it and you sign it on screen.
Legal basis and things to bear in mind
- Once the declaration is filed in time, and provided the importation was lawful and is documented, for 10 years from importation the item is under a special regime: if you apply for a permit to export it and the application is correct, it cannot be refused, no export tax is payable and the State cannot exercise its pre-emption rights (irrevocable offer of sale, tanteo and retracto). During those years it cannot be declared a Bien de Interés Cultural either, unless the owner asks for it.
- The deadline is 3 months from the date of importation, whether the item comes from outside the European Union (with the customs import declaration) or from another EU country (with proof of the date of entry). Before the 10 years run out, an extension for a further 10 years can be requested; if it is not requested in time, the item falls under the general regime of Ley 16/1985.
- The declaration does not replace the export permit: an item more than 100 years old, or entered in the Inventario General, needs prior authorisation from the State to leave Spain, and one that leaves without it becomes State property. What changes is that the permit cannot be refused. To take it outside the EU, the European Union export licence may also be needed.
- The regime is attached to the declared object, whoever owns it: if you sell it, give it away or it passes to your heirs, the change of ownership must be notified to the Ministerio de Cultura.
- It is a separate procedure from the import licence and the importer statement under Regulation (EU) 2019/880, which since 28-6-2025 are requested in the ICG electronic system before customs clearance: a licence for products of archaeological excavations and elements of dismembered monuments more than 250 years old, whatever their value, and a statement signed by the holder of the goods for the other cultural goods in Part C of the Annex more than 200 years old and worth 18.000 € or more per item. Its code goes on the customs declaration, and without it customs will not accept the declaration. The customs declaration is lodged by you (or your company) or by a registered customs representative: this service does not include it.
- If the item comes from outside the EU, customs duties and import VAT on it are assessed by customs on the import declaration and paid by you: this declaration to the Ministerio de Cultura does not change what is paid at customs.
