Legal basis and things to bear in mind

  • Legal framework: Ley 12/2012 + art. 69 Ley 39/2015 + Directive 2006/123/CE.
  • NOT VALID FOR HOSPITALITY. The annex to Ley 12/2012 lists the activities by IAE group and jumps from 66 to 69: it does not include 67 (restaurants, bars and cafés) or 68 (accommodation). A bar, restaurant or pub is governed by the regional law on public entertainment and leisure activities, the regional environmental law and the municipal bylaw. Filing this declaration for hospitality premises means the case starts without a valid legal title.
  • Immediate effect: you can start the activity on the very day of submission, without waiting for a decision (art. 69.3 Ley 39/2015).
  • Later checks: the Ayuntamiento can inspect afterwards. If the declared information turns out to be inaccurate or false, it can order the activity to stop and impose penalties (art. 69.4 Ley 39/2015).
