Legal basis and things to bear in mind

That procedure requires a procurador (court representative) and is NOT included in this service or its price.
- Minimum period from the marriage: 3 months (art. 81.2 CC). Exception: gender-based or family violence.
- Convenio regulador (settlement agreement) (art. 90 CC): it must include custody, child support, use of the home, contribution to expenses, compensations and liquidation of the property regime where applicable.
- Child support: the CGPJ (General Council of the Judiciary) guidance tables apply the % on net income according to the number of children and custody. The AP (Provincial Court) usually requires a minimum of 10-25% per child.
- Disproportionate spousal maintenance (>40% of the payer's income): the judge may declare it reviewable or reduce it.
