Legal basis and things to bear in mind

Legal framework: arts. 81-90 CC plus 770-778 LEC plus Ley 15/2015 (art. 87 CC, notarial route).
Deadline: 3 months since the marriage (art. 81 CC), except where there is a risk to life, physical integrity, freedom or sexual integrity.
Notarial route: NOT available if there are dependent non-emancipated minors or children with modified legal capacity.
