We formalise before a notary the voluntary SUPPORT MEASURES for a person with a disability, under the regime of Ley 8/2021 (which replaces incapacitación, the old system of having someone declared legally incapable): an autocuratela deed (you decide today who will support you tomorrow, and within what limits) or a poder preventivo (preventive power of attorney) with support measures. These voluntary measures take priority: when properly granted, they avoid having to go to court. If the person can no longer execute a deed, curatela (court-ordered guardianship) and the approval of an existing informal carer (guarda de hecho) can only be ordered by the court, in proceedings that require a procurador and that are not included in this service.
