Getting off ASNEF, Experian and the CIRBE after your debts are discharged
Getting off ASNEF, Experian and the CIRBE after your debts are discharged is filed with Entidades acreedoras afectadas y sistemas de información crediticia (ASNEF, de Equifax; Badexcug, de Experian), Central de Información de Riesgos del Banco de España y, si no corrigen el dato, la Agencia Española de Protección de Datos. With Managora you do it 100% online: you answer a few questions, sign a digital mandato (power of representation) and we draft, sign and file your application for you. What we charge you: from €199. Official tasa (government fee): No tasa (official fee). The requests to the creditors and the credit files, the right of access, the CIRBE report, the complaint to the Banco de España with the FDU-030 form and the complaint to the AEPD are all free. The letters we send, with proof of the date of receipt, are included in the price. The only thing you may pay is the postage if you post the FDU-030 (or the FDU-031 to request your CIRBE report) to the Banco de España; handing it in in person costs nothing.
With your auto de exoneración (court order granting the discharge of unpaid debts), we write formally to each creditor that registered you, requiring it to notify the discharge to the credit files it reported to and to correct the CIRBE, and to ASNEF (run by Equifax), Badexcug (run by Experian) and any other system, requiring them to update or erase the entry for the discharged debt; if you do not know what appears, we first request access to your data. For the CIRBE we leave the Banco de España FDU-030 form ready for you, which you sign by hand and send. If within a month any of them fails to reply or refuses, we file the complaint with the AEPD, included in the price.

Which documents do you need?
- •The auto de exoneración (court order granting the discharge: with liquidation of the estate, after a concurso sin masa (insolvency proceedings with no assets), or final discharge with a payment plan), in full and with the part that identifies the discharged debts; if you have the testimonio (certified copy) or the diligencia de firmeza (certificate that the order is final), those too.
- •Your CIRBE risk report, if you appear in the CIRBE and already have it.
- •The letter, email or screen from ASNEF, Badexcug or another credit file showing the entry, if you still have it.
Legal basis and things to bear in mind
- The auto de exoneración with liquidation of the estate, or the order granting final discharge with a payment plan, includes a mandamiento (court instruction) to the affected creditors to notify the discharge to the credit information systems they reported the default to, and the debtor may obtain a testimonio (certified copy) of the order and require those systems directly to update their records (art. 492 ter of the texto refundido de la Ley Concursal, the consolidated Insolvency Act). The law sets no deadline; whoever receives the request has one month to reply, extendable by two further months with notice within the first (art. 12.3 of Regulation (EU) 2016/679). With the provisional discharge under a payment plan there is no mandamiento: it comes with the final discharge.
- We write to the creditor and the credit file at the same time. The creditor is answerable for the debt it registered existing and being accurate (art. 20.2 of Ley Orgánica 3/2018), and the Agencia Española de Protección de Datos (AEPD, the Spanish data protection authority) has in the past found a credit file diligent for refusing removal because it was for the institution that made the entry to request it. Default data may only be kept while the default persists (art. 20.1.d), and a discharged debt can no longer be claimed (art. 490 of the texto refundido).
- What the discharge does not cover may remain registered: non-dischargeable debts (maintenance, civil liability arising from a criminal offence, criminal fines and very serious administrative penalties, the part of public-sector debt above the dischargeable limit or the debt secured on an asset up to the value of the security, among others); debts that were not in the list of creditors in the insolvency proceedings, because only the debts listed and identified in the order are discharged (Tribunal Supremo, judgments 254/2026 and 260/2026, of 18 February); entries in the name of those who guaranteed your debt or signed it with you (guarantors, sureties and joint and several co-debtors), because the discharge does not reach them (art. 492.1); and, under the community property regime (gananciales), those of your spouse until they obtain the discharge themselves (art. 491).
- The CIRBE is not a credit blacklist but the register of the risks that institutions report to the Banco de España, which cannot change that data. Correction is requested from the institution and, if it does not correct it, through the Banco de España with the FDU-030 form: the institution replies within 15 working days and, in the meantime, disclosure of that data to third parties is suspended (arts. 65 and 66 of Ley 44/2002). That route is only available for the transactions the report identifies with their code, those of institutions with which you have more than 1.000 euros of accumulated risk. A discharged debt must disappear from the CIRBE, not remain as extinguished.
- The Banco de España only accepts someone else signing the FDU-030 or requesting your CIRBE report on your behalf with a power of attorney in a public document for that purpose. That is why we prepare it for you and you sign it by hand. The CIRBE report is free and can be requested without a digital certificate or Cl@ve, in person with an appointment or by post to C/ Alcalá 48, 28014 Madrid, with the signed FDU-031 form and a copy of your DNI or NIE.
- A complaint to the AEPD (art. 77 of Regulation (EU) 2016/679) over a right that was not respected is only admitted if that right was first exercised before the controller and it did not reply in time or replied unsatisfactorily; that is why it comes last, with copies of our letters. The AEPD has up to 3 months to admit it and up to 6 months from admission to decide. The Court of Justice of the European Union (cases C-26/22 and C-64/22, of 7-12-2023) has held that a private credit information agency may not keep data on a discharge for longer than the public register.
