Regularising premises already trading without a licence, or without the right one
Regularising premises already trading without a licence, or without the right one is filed with Ayuntamiento del local. With Managora you do it 100% online: you answer a few questions, sign a digital mandato (power of representation) and we draft, sign and file your application for you. Estimated total cost: from €1,490. Official tasa (government fee): The tasas (official fees) of the relevant procedure (licence or declaración responsable), which in some municipalities carry a surcharge for having opened beforehand. The TECHNICAL REGULARISATION PROJECT, which is compulsory and signed by a chartered technician: 1.500 to 5.000 euros (your architect can supply it or we can arrange it for you). And the construction tax (ICIO), of up to 4 per cent of the works budget, which falls due EVEN IF no licence was obtained (art. 100.1 TRLRHL).
Your premises are open with no licence, or the licence you hold does not cover what you actually do (music, capacity, terrace, building works). It is also the classic case of someone who buys a business transfer and discovers that the previous operator was irregular. We regularise the file before the sealing order arrives, and if it has already arrived, we defend you. We tell you the real cost and the real timescale, which is something almost nobody does here.
This procedure is quoted case by case, not sold at a list price
the cost depends on the regularisation project your Ayuntamiento requires, on the state of your file and on whether you have already been sealed. We look at your case, give you a fixed quote in writing (our fee, the project and the taxes) and only then do we start. Tell us about your case and we will look at it: the quote is free and without obligation, and we confirm it in writing before we start.

Regularising premises already trading without a licence, or without the right one: how is it filed?
- 1You tell us what situation you are in and whether the Ayuntamiento already knows about it.

- 3We regularise. And if there is already a seal in place, we simultaneously ask for the closure order to be suspended.
- 4The project is signed by a chartered technician: you supply it or we arrange it for you.
Which documents do you need?
- •Your current licence, if you have one.

- •Technical regularisation project (your technician supplies it or we arrange it for you).
Legal basis and things to bear in mind
- MAXIMUM URGENCY AND GENUINELY HIGH DEMAND: the client arrives with the seal already in place or about to be. It justifies premium pricing, but it requires telling them the truth about the timescale (3 to 12 months) and the cost.
- IT IS ALSO THE CASE OF SOMEONE BUYING A BUSINESS TRANSFER who discovers the previous premises were irregular. That is why it links with traspaso_negocio_hosteleria, where this is spotted BEFORE buying.
- HONESTY IS COMPULSORY: while the regularisation is under way, the activity CAN BE SUSPENDED. Art. 69.4 LPAC prevents the activity from continuing once the Administration becomes aware of the essential inaccuracy. The client cannot be promised that they will stay open.
- THE REGULARISATION PROJECT IS COMPULSORY: it is signed by a chartered technician. What is optional is who does it. The client is never sent off to find one on their own.
- THE ICIO FALLS DUE EVEN IF NO LICENCE WAS OBTAINED (art. 100.1 TRLRHL). It must be disclosed: it is an expensive surprise.
- Verified legal framework: Ley 39/2015 art. 69.4; TRLRHL (RDLeg 2/2004) art. 100.1; regional planning legislation on the restoration of legality.
