Legal basis and things to bear in mind

  • Nature: INFORMATIVE declaration (no amount to pay). 3 blocks with independent thresholds of 50.000 € (accounts, securities/insurance/annuities, real estate).
  • Accounts: the threshold applies to the balance as at 31 December OR to the average balance of the last quarter (whichever is higher).
  • Re-filing: only obliged if in later years the total of any block INCREASES by >20.000 € compared with the last declaration, or if you no longer hold an asset that was previously declared.
  • Deadline: 1 January to 31 March of the year following the tax year. No extension possible.
  • Penalty regime AFTER Ley 5/2022 (following STJUE C-788/19): the ordinary LGT (General Tax Act) regime applies (~150-200 € per omitted item). The 150 % regime on the value of the asset and the non-time-barring rule NO LONGER apply.
  • Subjects: residents in Spanish territory (individuals and legal entities), permanent establishments and estates pending distribution.
  • Coordinate with IRPF (foreign capital income) and Impuesto sobre el Patrimonio (wealth tax) where applicable to avoid cross-checks and adjustments.
