Legal basis and things to bear in mind

  • IT IS NOT THE RGSEAA. Art. 2.2 of RD 191/2011 (as worded by RD 1021/2022) EXCLUDES catering establishments serving the final consumer from the national register. Charging a bar for an RGSEAA registration would be charging it for a procedure that does not apply to it: some people do exactly that.
  • You DO need the NATIONAL register (and then it is a different service) if you produce food for or supply other establishments, do catering or sell at a distance. That is why we ask.
  • A WINDOW IN MADRID: Decreto 26/2026 created the regional register in March 2026 and gave establishments already trading one year to register. There is a queue of trading premises that have to do it.
  • This notification does NOT replace the Ayuntamiento's opening licence. They are two different things and clients constantly confuse them.
  • Verified framework: RD 191/2011 art. 2.2 (as worded by final provision 1.1 of RD 1021/2022); RD 1021/2022 art. 2.2.a).
