If they can still make decisions, the preferred solution is the NOTARIAL one, and we provide it end to end with our own notary: autocuratela (self-appointed curatorship, art. 271 CC), a poder preventivo (enduring power of attorney) or a mandate with a survival clause, so that it is they who choose who supports them and within what limits, without setting foot in a court. If that is no longer possible, we prepare and file on their behalf the expediente de jurisdicción voluntaria (non-contentious court procedure, arts. 42 bis and following LJV), which requires NO procurador (court agent) and no lawyer: assistive curatorship, representative curatorship (exceptional), a defensor judicial (court-appointed representative) for a specific act, or de facto guardianship under court supervision. Ley 8/2021 PROHIBITS declarations of legal incapacity: the aim is the LEAST RESTRICTIVE support. A personal hearing is mandatory. The person's will and preferences are the guiding criterion (art. 249 CC). An honest warning: if any interested party opposes the court file, the matter turns into contentious proceedings, which do require a procurador and a lawyer and are NOT included in this service.
