Ley 8/2021 PROHIBITS declarations of legal incapacity: the aim is the LEAST RESTRICTIVE support. A personal hearing is mandatory. The person's will and preferences are the guiding criterion (art. 249 CC). An honest warning: if any interested party opposes the court file, the matter turns into contentious proceedings, which do require a procurador and a lawyer and are NOT included in this service.
