Legal basis and things to bear in mind
- Legal deadline: 6 calendar days from the effective date. Late variations are subject to penalties (art. 22.4 LISOS).
- If the variation involves a change in salary or working hours, a contractual novation must be signed with the employee. Without a novation, the TGSS may reject the variation.
- Conversion to a permanent contract: if the employee has been on consecutive temporary contracts for more than 24 months, conversion is COMPULSORY by law (art. 15.5 ET). Check if a conversion bonus applies.
- Transfer to another work centre: if it is in another province, a CCC (contribution account code) must first be registered in that province (use the inscripcion_empresa_ss procedure).
