Opening a clinic or aesthetic centre: the health operating authorisation

To open a medical or dental clinic, a physiotherapy practice or an aesthetic medicine centre, you need the health operating authorisation from your autonomous region (Real Decreto 1277/2003) before receiving your 1st patient. Tattoo and piercing studios follow their own regional regulations. In Madrid, the maximum resolution period is 3 months. Managora prepares the report and submits the application for you.

What is new, and the law that applies
- Real Decreto 239/2026, of 25 March (in force since 1 July 2026): new article 7 of RD 1277/2003 with healthcare guarantees (only professionals with official qualifications and appropriate competencies, updated staff file, information on safe practices for new professionals), new units U.106 Hospital radiophysics and U.107 Radiopharmacy, and update of the definitions of units U.11, U.33, U.36 and U.105. Centres have 6 months for staff adaptation and autonomous regions have 1 year to adapt the healthcare offer.
- Orden SND/1002/2024, of 18 September (in force since September 2024): the U.47 aesthetic surgery unit is reserved for doctors specialising in Plastic, Aesthetic and Reconstructive Surgery or another surgical or medical-surgical specialty with those competencies in their training programme; the U.48 aesthetic medicine unit maintains a doctor as responsible for non-surgical treatments.
- Madrid: Decreto 205/2023, of 19 July, extended the validity of the operating authorisation to 8 years (4 years for assisted human reproduction).
- Andalusia: 2026 tasas updated by Ley 8/2025, of 22 December (2026 Budgets); application form updated by Orden of 18 June 2025; a new authorisations decree with responsible declaration and communication is being processed.
- Andalusia, tattoo and piercing: since Decreto 130/2021, establishments submit a responsible declaration to the town hall instead of a prior health authorisation.
What is the difference between an installation and an operating authorisation?
The installation authorisation is requested before starting the building works, and only when the centre is newly created or requires a substantial alteration of the structure or facilities. The Health Department reviews the project and the plans on paper. A dental practice or clinic set up in an already suitable premises, without substantial building works or fixed electromedical equipment, can usually go straight to the operating authorisation.
The operating authorisation is the one that allows you to open: it is requested with the finished centre and usually includes an inspection visit that checks the actual facilities, equipment and staff. In the Community of Madrid, administrative silence for this procedure is negative, so you cannot open without an express resolution.
Afterwards, there is the modification authorisation (changes in healthcare offer, structure or ownership) and the periodic renewal: the authorisation expires and must be renewed within the period set by each region. In Madrid, the validity is 8 years (4 for assisted human reproduction) and the renewal is requested at least 3 months in advance; if it is not requested, the authorisation loses its validity and you have to start from scratch.
What are the premises requirements and who must be the technical health director?
The material requirements depend on the units you declare: reception and waiting areas, consultation rooms with an examination area and sink, toilets, cleaning and sterilisation conditions, and the specific equipment for each unit (for example, laser or radiodiagnostic equipment, which carries additional radiological protection requirements). Each region details them in its regulations: in Madrid, Orden 1158/2018 sets the general technical requirements for centres without hospitalisation.
Every centre designates a responsible person or technical health director with an official qualification appropriate to the healthcare offer. In a U.48 aesthetic medicine unit, the responsible person is a doctor; in a dental clinic, a dentist. From 1 July 2026, the new article 7 of Real Decreto 1277/2003 (introduced by Real Decreto 239/2026) also requires keeping an updated file of all healthcare staff, with their qualifications and specialties, and informing new professionals of the centre's safe practices.

What changes depending on the autonomous region?
Real Decreto 1277/2003 is only the common basis: the procedure, forms, tasas (official fees) and renewal are regulated by each autonomous region, and the differences are significant. Madrid articulates the procedure with Decreto 51/2006 (modified by Decreto 205/2023) and charges the tasa according to the type of centre; Andalusia does it with Decreto 69/2008 and a tasa per healthcare unit updated every year in its Budget Law; Catalonia applies Decret 151/2017.
In Madrid, furthermore, certain practices without fixed electromedical equipment renew through a simplified responsible declaration instead of repeating the entire authorisation. In Andalusia, there is an ongoing public consultation for a new decree that will introduce a responsible declaration and communication in some cases.

What about tattoo and piercing studios?
Tattooing, micropigmentation and piercing are not healthcare activities under Real Decreto 1277/2003: each region regulates them with its own hygienic-sanitary regulations, and the regime changes a lot. In the Community of Madrid, Decreto 35/2005 applies: the establishment must register in the regional registry before opening and meet requirements for structure, hygiene and training of the applying staff. In Andalusia, following Decreto 71/2017 (modified by Decreto 130/2021), there is no longer a health authorisation: a responsible declaration is submitted to the town hall before starting, and the applicators prove their competence through a certificate of professionalism, an academic Vocational Training qualification or accreditation of cumulative partial training.
Be careful with the boundary: if medical procedures are also performed in the studio (medical laser, mesotherapy, micropigmentation for health purposes), that part requires authorisation as a health centre with its corresponding unit. Advertising with health terms without authorisation is prohibited by article 6 of Real Decreto 1277/2003.

Define your healthcare offer
Choose the units from annex II of Real Decreto 1277/2003 that you are going to provide (for example, U.48 aesthetic medicine). The requirements, the health responsible person and the tasa depend on them.

Check if you need an installation authorisation(In Madrid, it is resolved in a maximum of 2 months)

Place the official badge in a visible place, include the registration number in your advertising and schedule the renewal (in Madrid, every 8 years, requesting it 3 months in advance).

Frequently asked questions
How long does the health operating authorisation take?
It depends on the region. In Madrid, the maximum resolution period is 3 months (2 months for the installation one) and in practice, you should count on the prior inspection visit. Submit the complete file the 1st time: each correction restarts the wait.
Can I open the centre while waiting for the resolution?
No. The operating authorisation is prior to the start of the activity and in Madrid, administrative silence is negative: without an express resolution, you cannot open. Doing so exposes the centre to penalties and closure.
What paperwork do I need to request it?
DNI, NIE (foreigner identity number) or CIF of the owner, dimensioned and signed plans of the premises, technical-health report, qualifications of the healthcare staff, designation of the health responsible person, civil liability policy, biohazardous waste management contract and proof of the regional tasa.
Does the town hall opening licence serve as a health authorisation?
No. They are independent procedures: the municipal licence authorises the premises for the activity and the regional health authorisation authorises the healthcare assistance. You need both before opening.
Can a general practitioner offer aesthetic medicine?
The U.48 aesthetic medicine unit requires a doctor to be responsible for non-surgical treatments; some regions add their own requirements. Aesthetic surgery (U.47) is different: since Orden SND/1002/2024, it is reserved for surgical or medical-surgical specialists with those competencies in their training programme.
Does the authorisation expire?
Yes, it has limited validity and is renewed periodically depending on the region. In Madrid, it lasts 8 years (4 in assisted reproduction) and the renewal is requested at least 3 months before expiring; if you do not request it, you lose the authorisation and would have to process it again from scratch.
