Changing or recovering your residence permit in Spain: from studies to work and more

The short answer

What is new, and the law that applies

  • Rules in force: Real Decreto 1155/2024, de 19 de noviembre (published in the BOE, the official state gazette, on 20 November 2024), approving the regulations implementing Ley Orgánica 4/2000. In force since 20 May 2025.
  • The change from a student stay to residence and work has been made more flexible: under the employed work option you are not required to prove the national employment situation.
  • The regulations allow permit renewals to be filed up to 90 days after the card expires, with no penalty on that ground.
  • The situations for changing between stay and residence and the procedures for recovering long-term status are set out in the new regulations and developed by administrative instructions from 2025 (for example, the instructions on students).

Which procedures does this guide cover, and which one do you need?

This guide brings together four immigration procedures that answer very different situations but are often confused with each other. If you have finished your studies and have a job offer, you need the change from a student stay to a residence and work permit. If you held a long-term residence permit and lost it, there is a procedure to recover that status. If your card is being renewed and you have to leave Spain, the autorización de regreso lets you come back. And if you want to host a foreign national coming to visit, the carta de invitación proves the accommodation.

All four procedures are governed by Real Decreto 1155/2024, de 19 de noviembre, in force since 20 May 2025. How do I switch from a student stay to a residence and work permit?

When you finish your studies or your training, you can change your student stay into a residence and work permit without leaving Spain. There are two routes: employed work, with an employment contract (form EX-03), and self-employment, as an autónomo (self-employed worker) with a business activity project (form EX-07). The application is filed online through Mercurio, the electronic office of the Ministerio de Inclusión, Seguridad Social y Migraciones (the Ministry of Inclusion, Social Security and Migration).

RD 1155/2024 has made this route more flexible: under the employed work option you are not required to prove the national employment situation, so the job offer is not conditional on the occupations catalogue. In general you are asked to have held a valid student or training stay (or to be within the application period), to have finished your studies, to have a job offer or contract compatible with your training and to have no criminal record.

The window to apply runs from two months before to three months after your student or training stay ends, or after you obtain your qualification. One important advantage: from the moment the application is admitted for processing, you can work full time while it is being decided. How do I get my Spanish residence back if I lost it or it expired?

It is worth distinguishing between two situations. If what expired was the card of a temporary residence permit because you did not renew it in time, RD 1155/2024 lets you file the renewal up to 90 days after expiry, without having to start from scratch. If, on the other hand, you held a long-term residence permit (Spanish or EU) and lost that status, normally because of a prolonged absence from Spain or from the European Union, there is a specific procedure: recovery of the long-term resident status.

Recovery of the long-term resident status is applied for with form EX-11, at the Oficina de Extranjería of the province where you want to settle, or online through Mercurio. You must have held that permit, not be a citizen of the European Union, the European Economic Area or Switzerland, not be in Spain irregularly and have no criminal record in the countries where you have lived in the last five years. The tasa is paid with modelo 790 código 052 (the long-term recovery heading).

The decision period is three months from the date the application enters the register; if there is no answer within that period, silence is positive and the application can be deemed granted. What is the autorización de regreso and when do I need it?

The autorización de regreso is the document that lets you leave Spain and enter again when your residence or stay permit is in the middle of a renewal or an extension, or when you have applied for a duplicate card because it was stolen, lost or damaged. Without it, if your card has expired or is being processed, you might not be able to return.

Its maximum validity is 90 days and, within that period, there is no limit on entries and exits with a single document. It is applied for with form EX-13 and the tasa modelo 790 código 012. It is filed at any Oficina de Extranjería, at police premises or through the electronic office of the Policía Nacional (the national police force). The decision does not exhaust the administrative route and, as it is neither a renewal nor an extension, silence is foreseeably negative under the general rules.

What is a carta de invitación and who can apply for one?

The carta de invitación is the document by which a person resident in Spain undertakes to host a foreign national coming to visit for tourism or private reasons, covering their accommodation costs during the stay. It can be applied for by a Spanish citizen, a national of a European Union member state, a beneficiary of the EU regime or a foreign national legally resident in Spain.

It is important to understand this properly: the carta de invitación is not a visa and does not replace the requirements for entering the Schengen area. It is one of the ways to prove the visitor's accommodation at border control. The host must provide their valid identity document (DNI, the Spanish national ID card, or NIE, the foreigner identification number), the documents for the home (title deed or rental contract) and pay the tasa modelo 790 código 012.

It is applied for in person at the Comisaría de Policía (police station) of the host's address, with a prior appointment, using the official issue application form (Orden PRE/1283/2007). How much does each procedure cost and how long does it take?

Each procedure has an official administrative tasa that is paid to the authorities and that is not Managora's fee. The Policía Nacional tasas (modelo 790 código 012) are fixed: the autorización de regreso is €10.72 and the carta de invitación adds €75.05 for the authorisation plus €6.54 for the issue. The residence tasas (790 052) and work tasas (790 062) for the change of permit and for the recovery vary depending on the situation.

As for timing, the long-term recovery is decided within three months; the autorización de regreso has a maximum validity of 90 days; and in the change from studies to work you can start working from the moment the application is admitted for processing. Step by step

    Confirm that you are within the deadline(From two months before to three months after your student or training stay ends, or after you obtain your qualification)

    Check that you have finished your studies or training and that you are inside the application window. Managora verifies your situation before starting the file.

    Get the job offer or the business project

    For employed work, a contract or job offer compatible with your training. For self-employment, a business activity project and proof of your solvency as an autónomo.

    Gather the documents

    Passport and valid student TIE (Tarjeta de Identidad de Extranjero, the foreigner identity card), qualification or certificate of completion, and, depending on the route, the contract plus the company's documents or the business plan and proof of solvency.     Pay the official tasas

    Residence tasa (modelo 790 código 052) and work tasa (modelo 790 código 062). The amount depends on the situation; you can see it on the service page for the procedure.

    File the application through Mercurio

    Form EX-03 (employed work) or EX-07 (self-employment) at the electronic office of the Ministerio de Inclusión, Seguridad Social y Migraciones. Managora files it for you.

    Work while the decision is pending

    From the moment the application is admitted for processing, you can work full time until the decision is issued.

    Collect the decision and have the TIE issued(The initial permit is usually granted for one year)

    With a favourable decision, the card tasa is paid (modelo 790 código 012) and your fingerprints are taken so that the Tarjeta de Identidad de Extranjero can be issued.

A worked example

A person resident in Spain wants to obtain the carta de invitación to host a relative coming to visit. They need to know the total official tasa before going to the police station.

  • Authorisation for the issue of the carta de invitación (modelo 790 código 012): €75.05
  • Issue of the carta de invitación (modelo 790 código 012): €6.54

Frequently asked questions

Can I start working before my change from studies to work is decided?

Yes. From the moment the application is admitted for processing you can work full time until the decision is issued. Managora files the application and confirms to you exactly when you are cleared to work.

My card expired and I did not renew it, can I get it back?

It depends on the type. If it was a long-term residence permit that you lost, normally because of a prolonged absence, there is the recovery of the status (form EX-11). If it was a temporary residence permit, you can still renew it within 90 days after expiry. Managora identifies your case and files the correct application.

My card is being renewed and I need to travel, can I leave Spain and come back?

Yes, with the autorización de regreso. It has a maximum validity of 90 days and lets you leave and enter while your card is being processed or renewed. It is best to apply for it ahead of your trip.

Does the carta de invitación replace the visa?

No. The carta de invitación proves the visitor's accommodation, but it is not a visa and does not replace the entry requirements. If the country of origin needs a visa, the visitor still has to apply for it.

Can I change my student stay to self-employment instead of to a job?

Yes. The self-employed change is applied for with form EX-07, proving the business activity project and your solvency as an autónomo. Managora prepares the complete file.
