Which documents do you need?

Legal basis and things to bear in mind

  • Legal framework: arts. 8/9 LH + arts. 44 and 45 Reglamento Hipotecario + art. 51 RD 1093/1997 + Ley 13/2015 (georeferenced coordinates).
  • AGRUPACIÓN (art. 44 RH): the merger of 2 or more adjoining properties of the same owner into a new one. The original properties are cancelled and a new one is born with a new registry number and IDUFIR.
  • AGREGACIÓN (art. 45 RH): one or more smaller properties are absorbed into a larger adjoining one. Each smaller one may not exceed 1/5 (20 %) of the larger; the larger keeps its registry number. If the ratio is not met, an agrupación must be used instead.
  • Common requirements: the properties must be shown graphically to ADJOIN, and to have the SAME OWNER (or the consent of all owners where there are several).
  • Charges over the property: unless otherwise agreed, mortgages, easements and seizures extend to the resulting property. Where only one of the original properties was charged, the creditor's consent is usually required to extend the security.
  • Georeferenced coordinates have been compulsory since Ley 13/2015 (art. 9.b LH) for the resulting property. Without them the Registro de la Propiedad (Land Registry) will suspend the entry.
  • AJD: 1,5 % of the declared value of the resulting property (the general rate). A reduction is common for operations arising from land consolidation or with an agricultural purpose.
  • Natural next steps: after merging, a declaration of new build (use obra_nueva_declaracion_rp) if you are going to build as a single unit on the resulting plot; or segregacion_rp if you later want to split it.
  • Until the agrupación or agregación is registered, the properties keep their separate registry numbers and must be treated as independent assets in every later transaction.
