Asbestos certificate to sell or let a property in Catalonia: how is it filed?

  1. 1Answer the questions (about 5 minutes): where the property is, when it was built, what you are going to sign and when, and who will let the technician in.
  2. 2Before charging you, we use your answers to check that the obligation applies to you: a property in Catalonia built before 2003. If you do not know the year, we look it up in the Catastro before booking the visit.
  3. 3Payment of 149,00 € for one property or 299,00 € for a whole building, an industrial unit or several properties (21 % VAT incl.), and signature of the mandate from your phone.
  4. 4We arrange the visit of a qualified technician (architect, technical architect, engineer or technical engineer) in your municipality and send you their quote before confirming it. You pay their fees directly to them.
  5. 5The technician inspects the accessible areas in person and issues the certificate using the basic template of the Agència de Residus de Catalunya (ARC, the Catalan Waste Agency): visible asbestos, its condition and the risk to people. If they see suspicious materials or there are areas they cannot reach, they record it.
  6. 6We check that the certificate contains the minimum content required by law and identifies the property correctly.
  7. 7We give you the certificate, the clause for your deposit (arras), sale or tenancy contract, and a receipt of delivery for the buyer or tenant to sign.

Which documents do you need?

  • •No document is compulsory: the property details come from the Catastro (Land Registry cadastre) and the technician issues the certificate at the visit.
  • •Optional: the draft deposit contract (arras), sale contract or tenancy agreement, if you want the clause built into its text.
  • •Optional: an earlier report on the building (technical inspection, previous asbestos certificate or analysis, or removal certificate).

Legal basis and things to bear in mind

  • The obligation applies only to properties located in Catalonia. In the rest of Spain no national or regional rule currently requires an asbestos certificate to sell or let, although the buyer or tenant may ask for one.
  • The certificate describes the visible asbestos in the accessible areas on the day of the visit, its condition and the risk to people. It is a visual inspection: it does not include sampling or laboratory analysis. If there are inaccessible areas, it is limited to what was inspected and warns that hidden materials may exist; if the technician sees a suspicious material, they may state that it should be analysed, and they quote for that analysis separately.
  • For a flat, office or unit within a building, according to the Agència de Residus de Catalunya (ARC, the Catalan Waste Agency) the certificate covers that unit only and not the communal parts, such as the roof or the façade.
  • According to the ARC, the certificate is required for properties built before 2002, it is enough to have it before signing the contract, and it currently has no expiry date: it is valid for successive lettings as long as the property has not been altered. A property built or refurbished during 2002 may still contain asbestos: we treat it as earlier.
  • Finding asbestos does not prevent you from selling or letting. What you must never do is handle it, break it, paint it or clean it with a pressure washer. It is removed by a specialist company, as a rule one registered in the RERA (Spain's register of companies working with asbestos risk). As at 3 October 2026 there is no open grant scheme in Catalonia for its removal.
  • The law classes failing to hand over the certificate as a minor offence, with a fine of 100 to 3.000 €, but those penalty provisions will not apply until the implementing decree is approved. The obligation towards the buyer or tenant has existed since 3 October 2026. The law does not make signing the deed conditional on handing it over, but it is advisable to bring it to the signing.
