Legal basis and things to bear in mind

  • Legal framework: RD 95/2009 (system of administrative registers supporting the Administration of Justice) + CP art. 136 + Ley 39/2015.
  • SPENT convictions do not appear on the certificate (CP art. 136). If yours have already served their term but still show up, what you need is the cancellation, not another certificate.
  • Validity: the certificate does not expire by itself, but almost every authority requires it to have been issued within the last 3 months.
  • The Registro Central de Penados certificate is NOT the police records certificate of the Ministry of the Interior, which is a different document and a different procedure.
