End-user certificate to import rare earths, magnets and critical minerals from China (MOFCOM export licence)

End-user certificate to import rare earths, magnets and critical minerals from China (MOFCOM export licence) is filed with MOFCOM, Ministerio de Comercio de la República Popular China (la licencia la pide su proveedor chino; usted firma el certificado). With Managora you do it 100% online: you answer a few questions, sign a digital mandato (power of representation) and we draft, sign and file your certificate for you. What we charge you: from €499. Official tasa (government fee): No official fees in Spain: the end-user certificate is a private document of your company and no Spanish public body is involved or charges anything for it. Your supplier applies for and handles the export licence with MOFCOM: any cost of that procedure in China is handled by your supplier and is not part of our price. If MOFCOM also asked for an official Spanish certificate, it is processed separately through our Certificado Internacional de Importación (International Import Certificate) service. The 21 % IVA (VAT) on our fee is included in the price.

We draft the end-user and end-use certificate that your Chinese supplier must file with MOFCOM to apply for the export licence for rare earths, magnets, gallium, germanium, graphite or antimony: in English and Spanish, adapted to your supplier's template if they have sent you one, together with the letter of undertakings (civil use, no transfer or re-export without MOFCOM's permission, and cooperation with verification). First we check that the contract, the pro forma invoice and the technical data sheet say the same thing, screen the MOFCOM control and watch lists and Council Regulation (EU) No 833/2014, and tell you whether MOFCOM may also ask you for an official Spanish certificate. You sign it and your supplier files it with MOFCOM, which decides on the licence.

Which documents do you need?

  • •Contract, purchase order or pro forma invoice with your Chinese supplier.
  • •Technical data sheet of the product or test report (composition, purity or grade, form and, for magnets, whether they contain terbium or dysprosium).
  • •The certificate template your supplier has sent you, if they have sent one.
  • •End-user and end-use certificate and letter of undertakings: we draft them and your legal representative signs them.

Legal basis and things to bear in mind

  • The export licence is applied for by the Chinese exporter with MOFCOM, not by you. With the application it files the contract, the technical description or test report and the end-user and end-use certificate (art. 16 of China's Regulations on the Export Control of Dual-Use Items, Decree 792, in force since 1 December 2024). That certificate is issued by the end user itself (art. 24).
  • What needs a licence today: since 4 April 2025 (Announcement 18/2025), samarium, gadolinium, terbium, dysprosium, lutetium, scandium and yttrium, and samarium-cobalt magnets and NdFeB magnets containing terbium or dysprosium, as magnets or magnetic powder; the announcement does not mention finished products with magnets already fitted. Also gallium and germanium (since 1 August 2023), high-purity, high-strength and high-density synthetic graphite and natural flake graphite and its products (since 1 December 2023), and antimony ore and raw materials, antimony metal and its products and some high-purity antimony compounds (since 15 September 2024). The announcements of 9 October 2025 (55 to 58, 61 and 62) are suspended until 10 November 2026 (Announcement 70/2025). If the suspension is not extended, they may apply again, bringing back the controls on holmium, erbium, thulium, europium and ytterbium and on magnets containing holmium (Announcement 57/2025).
  • MOFCOM decides within 45 working days from accepting the application, not counting the time taken by verifications, expert consultations or inspections (art. 17). An individual licence covers one export to a single end user and is valid for 1 year at most; a general licence covers several exports and is valid for 3 years at most, and only an exporter with an internal compliance programme, an export track record and stable end users can apply for one (arts. 15 and 16).
  • With the certificate you undertake not to change the end use or transfer the item to third parties without MOFCOM's permission (art. 24). If you do not cooperate in time with the end-use verification, MOFCOM may put you on the watch list, and your supplier will no longer be able to sell to you under a general licence (art. 26); anyone who breaches the end-user or end-use requirements may be put on the control list, with transactions prohibited, restricted or suspended (arts. 28 and 29).
  • In 2026 MOFCOM has added 21 European Union entities to its control list (Announcements 20/2026 and 30/2026) and prohibits foreign third parties from transferring Chinese-origin dual-use items to them. If you resell the product, check first who to: we screen the customers you give us.
  • MOFCOM may also require a certificate issued or certified by a public body of the end user's country (art. 24). In Spain, the official document available is the Certificado Internacional de Importación (International Import Certificate), issued by the Secretaría de Estado de Comercio (annex VI.17 of RD 679/2014) at the request of the importing company, also for goods not subject to control in Spain (art. 31.2), and valid for 6 months. The Ministry of Defence's Certificado de Último Destino (end-use certificate for defence material) is not suitable, as it is only for defence material.
  • Your supplier files it with MOFCOM and MOFCOM decides on the licence: we cannot guarantee either the outcome or the timing. The import declaration at Spanish customs is lodged by your company or by a registered customs representative; we do not lodge it.
