Legal basis and things to bear in mind

  • No cap on the amount since Ley 42/2015 (previously it was 250.000 €).
  • Representation: the initial claim of the monitorio does NOT require a lawyer or procurador, whatever the amount (art. 814.2 LEC). A lawyer and a procurador only become necessary if the debtor opposes and the matter turns into a juicio (full court proceedings), or in a later enforcement: these are judicial stages that are not part of this service.
  • Prescription: 5 years for ordinary contractual debts post-Ley 42/2015 (art. 1964 CC); 3 years for professional fees (art. 1967 CC).
  • Broad range of admissible documentation (art. 812 LEC): invoices whether signed or not, delivery notes, contracts, certifications from a community of owners, etc.
  • Tasa (court fee): natural persons are exempt (Ley 25/1986 + STC 140/2016); legal persons pay 100 € fixed + 0,5 % variable (DA Ley 10/2012).
