Legal basis and things to bear in mind

  • The rectification of registered gender is highly protected data (Art. 83 of Ley 20/2011 of the Registro Civil) and will not be publicised without your authorisation.
  • The resolution of the procedure orders the cancellation of your old birth record and the opening of a new registry page to guarantee the shielding of your privacy (Art. 307 of the Reglamento del Registro Civil).
  • Standard literal certificates can be issued from the new record without any mention of the change appearing, unless expressly requested or under special authorisation.
  • If you live outside Spain, the case file is handled by the Oficina Consular (consular office) of the Registro Civil for your district, and both appearances take place there. You may choose an Oficina General (general office) in Spain instead, but then both appearances take place in Spain.
  • No certificado de empadronamiento (municipal census registration certificate) is required: the Instrucción of the DGSJFP of 26 May 2023 rules it out, because the application may be lodged at any office of the Registro Civil.
