How to appeal a traffic fine in Spain (DGT)

Appealing a traffic fine means challenging a penalty notice before the DGT (the Spanish traffic authority) when you disagree with it. You have 20 calendar days from notification to file written submissions (alegaciones), or to pay with a 50% discount, and 1 month for the recurso de reposición (an internal review appeal) against the decision. What is new, and the law that applies
- Law in force: Real Decreto Legislativo 6/2015, de 30 de octubre, texto refundido de la Ley sobre Tráfico, Circulación de Vehículos a Motor y Seguridad Vial (the consolidated Spanish Traffic Act), published in the BOE (the Spanish official gazette) of 31/10/2015, consolidated and in force as at 17/07/2026.
- Most recent relevant reform of the penalty points system: Ley 18/2021, de 20 de diciembre (the reform of the driving licence points system), in force since 21/03/2022. It does not change the appeal deadlines or the early payment discount.
- As at 2026 the key deadlines remain: 20 calendar days for early payment with the 50% discount and for written submissions, and 1 month for the recurso de reposición.
What does appealing a traffic fine mean, and when is it worth it?
Appealing means challenging the penalty notice before the DGT itself when you consider that the penalty is not lawful: you were not the offender, there is a defect in the notification or in the procedure, or the speed camera did not meet the required conditions.
Before you appeal, consider early payment (pronto pago). Within the 20 calendar days following notification you can pay the fine with a 50% discount. If you pay, you are deemed to waive the right to file written submissions (alegaciones) and the procedure ends.
Appealing makes sense when there is a real ground of defence. Filing written submissions and appeals before the DGT is free of charge. What are the deadlines to appeal a DGT fine?
20 calendar days from the day after notification: this is the deadline both to pay with the 50% discount and to file written submissions. You cannot do both: if you pay, you waive the right to make submissions.
1 month from notification of the penalty decision: this is the deadline for the recurso de reposición (an internal review appeal before the DGT itself), which is optional (you can either file it or go straight to court).
2 months: this is the deadline for the contencioso-administrativo appeal before the court, once the administrative route has been exhausted.
Bear in mind that deadlines counted in calendar days include Saturdays, Sundays and public holidays, whereas the 1 month period runs from date to date.
What grounds for annulment can I raise against a fine?
Defective notification: the notice was not validly served, it was sent to the wrong address, or it was published on the official notice board or in the official gazette without first exhausting personal service methods.
Expiry of the procedure (caducidad): more than 12 months have passed since the file was opened without the penalty decision being issued and notified. In that case the file must be closed.
Limitation (prescripción): the infringement was not validly notified within 3 months (minor infringements) or 6 months (serious and very serious ones) from the date the events took place.
Speed camera or cinemómetro (speed measuring device): a device without a valid metrological verification, badly positioned, without the required advance signage, or without the legal margin of error applied. You can also raise defects in the penalty notice form (boletín de denuncia), such as a missing identification of the officer, of the provision infringed or of the facts. Success depends on each specific case.
Do I have to name the driver, and what happens if I do not?
The registered keeper of the vehicle has a legal duty to give the DGT the identity of the driver responsible when the DGT requires it (article 11 of the Ley de Tráfico, the Spanish Traffic Act). The deadline is 20 calendar days from the day after the request.
Identification is compulsory whenever the DGT requires it. In practice the request is usually issued for infringements that carry a deduction of points, but the duty to identify exists in every case in which the authority asks for it. You must provide the driver's name, surnames, document number (DNI, the Spanish national ID card, passport or residence permit) and address.
Failing to identify the driver, or doing so with false or insufficient details, is in itself a very serious infringement. The fine for failing to identify is double the fine set for the original infringement if that one was minor, and triple if it was serious or very serious, and it does not qualify for the 50% reduction.

What is the contencioso-administrativo court route?
If the DGT rejects your written submissions and, where applicable, your recurso de reposición (or does not decide it within 1 month, which counts as a rejection by administrative silence), you can still go to court.
The deadline is 2 months from notification of the act that exhausts the administrative route, or from the date on which the recurso de reposición is deemed rejected. The claim is filed before the Juzgado de lo Contencioso-Administrativo (the administrative court).

Find the file number and the notification date(As soon as possible)
Note down the penalty file number (12 digits) and the day you were notified: that is when the deadlines start to run.

Decide between early payment and appealing(20 calendar days from notification)
Within the first 20 calendar days you can pay with a 50% discount (and everything ends there) or file written submissions (you lose the discount). You cannot do both.

Photographs, the vehicle sale contract, witnesses, receipts, details of the signage or of the speed measuring device: whatever supports your defence.

A document with the file number, your details, the grounds and the evidence, filed in the DGT electronic office, at a public registry office or at a Tráfico office.

Wait for the decision
The DGT decides. If it finds in your favour, it closes the file. If not, it notifies you of the penalty, which you will have to pay at 100% unless you appeal.

If you disagree with the decision, file the recurso de reposición before the DGT. It is optional.

Frequently asked questions
How long does it take for an appeal against a fine to be decided?
There is no fixed deadline for a reply, but if the DGT does not decide and notify within 1 year from the start of the procedure, the procedure expires and the file is closed. The recurso de reposición is deemed rejected if it is not decided within 1 month, and from that point the deadline for going to court starts to run.
If I appeal, do I lose the 50% discount?
Yes. The 50% discount only applies if you pay within the 20 calendar days. If you file written submissions you waive the discount, and if they are rejected you will have to pay 100% of the penalty.
What happens if I neither pay nor appeal the fine?
The procedure continues, a decision is issued for 100% and, once it is final, it moves to enforcement proceedings (vía de apremio), with a surcharge and possible seizure of assets. Points are also deducted if the infringement carries them.
Can I appeal a speed camera fine if it was not signposted or not verified?
You can raise that. Speed measuring devices must hold a valid metrological verification and respect the margins of error; defects in the signage or in the verification may lead to annulment, depending on each case.
Do I still lose points even if I identify the driver?
Points are deducted from the identified driver, not from the registered keeper. If you were not driving at the time of the infringement, identifying the driver transfers responsibility to the person who actually committed it.
Does appealing stop the fine from being collected?
While the procedure is still open, payment cannot be demanded. The recurso de reposición does not by itself suspend enforcement once the penalty is final; to suspend it you have to ask for that expressly. Managora takes care of that step.
