Which documents do you need?

Legal basis and things to bear in mind
- Legal framework: arts. 1542-1582 CC (lease of a thing) plus Supreme Court case law (renting out a room is NOT directly governed by the LAU) plus LAU art. 8 (partial sublet: written consent and proportionate rent) plus the LIRPF and the tax rulings DGT V0357-19, V1149-22.
- Renting out a room is NOT covered by the LAU as a typical main-home tenancy (the LAU requires a self-contained habitable building, art. 2). The Código Civil and freedom of contract apply.
- Sublet (LAU art. 8): if the grantor is the tenant of the whole flat and sublets a room, they must have the landlord's WRITTEN CONSENT. The sublet rent cannot exceed the share of the main rent corresponding to the room let out.
- The 60 % IRPF reduction (LIRPF plus DGT practice): it applies to a room rental if the home is the grantor's main home AND the room is let as the tenant's main home. It applies only to the share of the property let out.
- Fianza (security deposit): freely agreed, since the LAU does not apply directly. It is usually 1 month's rent.
- Shared areas and house rules: expressly set out the use of the kitchen, the bathroom and the living room, plus cleaning, noise, visitors, smoking and pets. This is the main source of conflict in shared flats.
- Natural connections: arrendamiento_vivienda_lau (if the room ends up being treated as a main home), conciliacion_civil (mediation between flatmates) (non-payment or eviction from a room).
