Legal basis and things to bear in mind
- Legal framework: arts. 1526-1536 CC plus LH art. 149 (mortgage-backed) plus the LITP-AJD plus Supreme Court case law.
- Notice to the debtor (art. 1527 CC): ESSENTIAL for the assignment to be enforceable against the debtor. Without notice, payment to the assignor discharges the debtor's obligation.
- The assignor's guarantees (art. 1529 CC): the assignor is liable for the existence and legitimacy of the debt UNLESS OTHERWISE AGREED. They are NOT liable for the debtor's solvency, unless expressly agreed or unless the insolvency is public knowledge.
- Debt in litigation (art. 1535 CC): the debtor has a RIGHT OF REDEMPTION for 9 days from the demand. They may extinguish the debt by paying the assignee the price plus interest plus costs.
