Legal basis and things to bear in mind

  • The order of the surnames must be agreed by both parents; otherwise, if the Registro Civil asks them to decide, they will have a maximum of 3 days to notify it.
  • If the person applying lives abroad, the procedure falls to the Registro Consular. If they live in Spain, the birth is registered first at the Registro Central and then transferred to the Consular registry.
  • If a surname of foreign origin has a masculine or feminine variant in the country of origin, it may be recorded in that form provided its use is evidenced (for example, before a consul or a notary).
  • Initial doubt about nationality, or not yet being registered with the Consulate, is not an obstacle to registration.
