Second chance law (Ley de Segunda Oportunidad): personal insolvency and discharge of your debts, lawyer and procurador included
Second chance law (Ley de Segunda Oportunidad): personal insolvency and discharge of your debts, lawyer and procurador included is filed with Sección de lo Mercantil del Tribunal de Instancia de su provincia (presenta nuestro procurador). With Managora you do it 100% online: you answer a few questions, sign a digital mandato (power of representation) and we draft, sign and file your application for you. What we charge you: from €1,999. Official tasa (government fee): No court tasa (official fee): individuals are exempt (0 €), and publishing the notice in the BOE and in the Registro público concursal (public insolvency register) is free. The lawyer, the procurador (court representative) and their fees are included in the price, as are the Registro de la Propiedad (land registry) extracts we request. Not included, and only if they arise: the valuation of the home by an appraisal company approved by the Banco de España, if you keep a mortgaged home through a payment plan (unless one exists from the six months before the insolvency), which you pay to the appraisal company; and the fee of the administrador concursal (insolvency practitioner) where the law charges it to the estate, which comes out of your assets (if creditors ask for one in a no-asset insolvency, they pay it). Nor does the price include the other side's costs if the judge ordered you to pay them in an incidental proceeding. Granting the power of attorney to the procurador at a court office is free.
We handle Spain's Ley de Segunda Oportunidad (second chance law) from start to finish, with our own lawyer and our own procurador (court representative): we check whether you meet the requirements and the good-faith test before filing anything, gather the documents with you without asking for your digital certificate, draft and file the insolvency petition with the Sección de lo Mercantil del Tribunal de Instancia (commercial section of the court of first instance), notify the insolvency to whoever is garnishing you, apply for the exoneración del pasivo insatisfecho (discharge of unpaid debts), with no assets, with liquidation or with a payment plan, and defend it against any creditor who objects. After the discharge order with liquidation, or the final one under a payment plan, we require the credit reference files to update your record. The discharge is granted by the judge.

- Processing time
- There is no single legal deadline: it depends on the route and on each court's workload. Once the petition is filed, the judge examines it on the day it is allocated or the next working day and, if the conditions are met, declares the insolvency on the following working day. In a concurso sin masa (no-asset insolvency), creditors have 15 days from the notice to ask for an administrador concursal (insolvency practitioner); if nobody does, we apply for the discharge within the next 10 days and creditors have 10 days to object. With assets, the discharge is requested when the liquidation ends. With a payment plan, the provisional discharge comes when the plan is approved and the final one when it ends, after 3 or 5 years.

Second chance law (Ley de Segunda Oportunidad): personal insolvency and discharge of your debts, lawyer and procurador included: how is it filed?
- 1Answer the questions (around 15 minutes). If any answer shows that a discharge is not possible in your case, we tell you before you pay.
- 2A single payment, VAT included, depending on what you tell us: No assets 1.999 €, With assets or payment plan 2.999 € and Complex case 3.999 €. If your spouse or partner applies at the same time for their own insolvency and discharge with us, 999 € is added. Lawyer, procurador (court representative) and removal from credit reference files after the order are included.
- 3Preliminary review with the lawyer: we check the requirements and the good faith the law demands, in line with the Tribunal Supremo (Supreme Court) rulings of 18 February 2026; which debts would be cancelled and which would not; how much of what you owe to each public authority can be discharged; and which route to take: concurso sin masa (no-asset insolvency), liquidation, payment plan or the special procedure for micro-businesses. If we see it is not possible, we tell you before filing anything.
- 4We gather the documents with you. We tell you what to request and how to do it without a digital certificate or Cl@ve: the CIRBE report with form FDU-031, by post or in person at the Banco de España; your vida laboral (employment history report); and your income tax (IRPF) returns for the last three years. With your authorisation we request the Registro de la Propiedad (land registry) extracts ourselves and, as a colaborador social (authorised tax intermediary), the certificate of debts from the Agencia Tributaria (Tax Agency): it arrives in your electronic mailbox or at your tax address, and you forward it to us by uploading it to your file.
- 5You grant the special power of attorney to our procurador, free of charge: in person, at any court office, without a certificate or Cl@ve, or online at the Sede Judicial Electrónica (court e-office) if you have an electronic DNI or a certificate. We leave it ready for you and tell you exactly what to say.
- 6We draft the petition on the official form, with the memoria (statement of your financial history), the inventory of your assets and the list of ALL your creditors (a debt that is not listed is not discharged), and our procurador files it with the Sección de lo Mercantil del Tribunal de Instancia (commercial section of the court of first instance) in your province. If you are still trading as a self-employed person, it goes through the special procedure for micro-businesses, with its official forms.
- 7Once the insolvency is declared, we notify the order to whoever is garnishing you (courts, Agencia Tributaria, Seguridad Social, your employer) so that enforcement stops.
- 8We run the insolvency according to your route. No assets: we watch the 15 days creditors have and apply for the discharge within the next 10 days, with your IRPF returns and your signed statement that no ground for exclusion applies to you. With assets: we run the insolvency with the administrador concursal (insolvency practitioner) and apply for the discharge when it ends. With a payment plan: we propose it, defend it and, when it ends, apply for the final discharge.
- 9If any creditor objects to the discharge, we answer them within the insolvency proceedings themselves.
- 10When the order allows it (discharge with liquidation, or final discharge with a payment plan), we request a certified copy and require ASNEF, Experian (Badexcug) and the creditors to update their records. We leave form FDU-030 ready for you to sign so that the CIRBE reflects the discharge.

Legal basis and things to bear in mind
- Any individual, self-employed or not, who cannot pay their debts or soon will not be able to, and who is a debtor in good faith, can apply. There is no minimum debt and no need to try an agreement with creditors first, but you must have at least two. Good faith means not falling within any of the grounds for exclusion in the law (art. 487.1): certain unpaid convictions or very serious penalties from the last 10 years, a culpable insolvency, failing to cooperate with the judge, or having taken on debt recklessly or negligently, among others. According to the Tribunal Supremo (Supreme Court, rulings of 18 February 2026), the judge checks this of their own motion even if nobody objects, and you must explain where any debts came from that were out of proportion to your income at the time.
- The debts listed in the petition are cancelled, except those the law excludes (art. 489.1): maintenance payments, civil liability arising from a crime or for death or personal injury, criminal fines and very serious penalties, certain wages and the mortgage up to the value of the security, among others. With each public authority (Agencia Tributaria, Seguridad Social, town council, regional government) the first 5.000 euros are discharged in full and half of the rest, up to 10.000 euros for each one, and surcharges, interest and penalties that are not very serious are discharged in full: of 8.000 euros owed to Hacienda (the tax authorities), 6.500 are discharged. Only in the first discharge.
- There are two routes. With liquidation, your seizable assets are sold (or there is nothing to sell, in a concurso sin masa (no-asset insolvency), which is the most common case) and the discharge is final from the moment it is granted. With a payment plan, you keep your assets and pay what you can for 3 years, or 5 if you keep your main home or if the payments depend mainly on your future income; the discharge is provisional until the plan ends. If you keep a mortgaged home, the instalment is recalculated on the part of the debt that does not exceed the value of the security, which is 90 % of its value according to an approved valuation.
- Garnishments are suspended from the moment the judge declares the insolvency, not from when the petition is filed, and suspending is not cancelling. Employment-related enforcement and enforcement by Hacienda, the Seguridad Social or another public authority with an earlier attachment may continue if the insolvency judge declares that the asset is not needed for your activity; mortgages follow their own rules.
- The discharge does not release your guarantors, sureties or co-debtors, and under gananciales (community of property) it does not extend to your spouse until they obtain it themselves. For 3 years a creditor may ask for it to be revoked if you hid assets or income, if your situation improves significantly through an inheritance, legacy, gift or gambling win, or if a conviction or penalty arrives from proceedings that were already under way. To apply for another discharge you must wait 2 years after a payment plan or 5 after a liquidation, and the new one never covers public debts.
- The discharge order with liquidation, or the final discharge order with a payment plan, instructs creditors to notify it to the credit reference files; the provisional discharge does not yet. With a certified copy of the order, whoever receives the request has one month to reply and, if they do not, a complaint can be made to the AEPD (Spanish Data Protection Agency).
- The lawyer and the procurador (court representative) are compulsory and included, and the court tasa (official fee) is 0 for individuals. Not included, and quoted separately by the law firm: appeals, amending the payment plan or defending against an application to revoke the discharge.
