Legal basis and things to bear in mind

  • Framework: RD 1155/2024 arts. 125.1.d) (the «arraigo socioformativo» type), 126 (general requirements, including the 2 years of stay under art. 126.b) and 127.d) (specific requirements). Verified against the consolidated text of the BOE (BOE-A-2024-24099).
  • No own economic means are required, but art. 127.d) in fine DOES require a social integration report in the terms of art. 127.c). Do not confuse it with arraigo social.
  • Allowed training: those of arts. 52.1.b) and 52.1.e) 5.º (including level one) and the in-person offer of compulsory adult education; or the commitment to a Servicios Públicos de Empleo (public employment services) training course oriented towards the Catalogue of art. 75.1. The regulation does NOT set a minimum training duration.
  • If the enrolment has an official deadline, the application must be submitted within the 2 months before that deadline begins. Enrolment is proven to the Oficina de Extranjería (Immigration Office) within the 3 months following notification of the grant; failing to prove it terminates the authorisation (art. 127.d).
  • Requirement added by RD 316/2026 (art. 126.h): not holding a stay or residence authorisation, nor being an interested party in a procedure to grant, extend, renew or modify one.
  • It allows work as an employee for a maximum of 30 hours per week overall, with a wage at the SMI (national minimum wage) or the applicable collective agreement in proportion to the working hours (art. 131.b).
  • Renewal is conditional on the centre's report certifying progression to the second year (basic or intermediate level), or on proof of the qualification or certificate obtained if you finished the training before the year ended (art. 132.b).
