Which documents do you need?

  • DNI / NIE / CIF (identity or tax numbers) of the landlord and the tenant.
  • Evidence that the tenant's habitual home is somewhere other than the property (empadronamiento (municipal census registration), employment history, employment contract).
  • For a tourist let: the certificate of entry in the regional register (VT/VFT/HUTB/ETV).
  • For students: enrolment at the academic institution, to evidence the purpose.
  • For temporary work: the employment contract or a document evidencing the posting.
  • A photographic inventory of the condition of the property and meter readings.

Legal basis and things to bear in mind

  • Legal framework: LAU 29/1994 art. 3.2 (seasonal lets) plus Title III (residual regime) plus RD 1070/2022 (modelo 179 AEAT) plus RD 933/2021 (traveller register) plus the regional tourist-accommodation decrees plus LIVA arts. 20.1.23 and 91.1.2.2º.
  • The key difference: the tenant's habitual residence is SOMEWHERE ELSE. The property is used temporarily for a specific purpose.
  • MAIN RISK: if the temporary purpose is not evidenced, or the contract runs for more than 11 months with a permanent intent, the courts may RECLASSIFY it as a main-home tenancy, with the compulsory 5/7-year extension.
  • Tourist lets: each CCAA has its own regime and registration number. Advertising without a registration number is penalised (fines from 1.000 to 600.000 € depending on the region).
  • Modelo 179 AEAT: a quarterly information return filed by the INTERMEDIARY or PLATFORM (Airbnb, Booking and so on). The landlord does not file it, but must make sure the platform does.
  • Traveller register (RD 933/2021): compulsory for professional operations. The guest's details must be reported to the Mossos or the Police within 24 hours.
  • IVA: residential letting is exempt (art. 20.1.23 LIVA). If hotel-type services are provided (reception, cleaning during the stay, change of linen), it is taxed at 10 % (art. 91.1.2.2º LIVA).
  • IRPF: income from immovable capital, with no 60 % reduction (that only applies where it is the tenant's main home). If the activity is continuous and professional, it may amount to an economic activity (art. 27.2 LIRPF): registration as autónomo (self-employed).
