Legal basis and things to bear in mind
- Framework: art. 22 RD 625/1985 + art. 209.1 TRLGSS + the SEPE Resolution of 3 February 2010 (online filing is compulsory).
- The obligation: EVERY termination of an employment relationship triggers the certific@2 obligation, whether it is a dismissal, the end of a contract, a resignation, retirement, and so on.
- Legal deadline: 10 calendar days from the termination.
- Benefit base: the SEPE calculates the unemployment benefit from the contribution bases of the 180 calendar days before the termination. Without complete bases, the SEPE will block the employee's benefit.
- Penalty under art. 14.4 LISOS: a serious infringement carrying 751-7.500 € for failing to file or filing late.
- The certificate is filed by the EMPLOYER. The employee cannot file it, only ask the employer to comply.
- Reasons that give entitlement to contributory unemployment benefit: 51, 52, 53, 54, 55, 75, 84, 91, 93. Codes 92 (resignation) and 94 (retirement) do not.
- If the employer refuses to file the certificate, the employee can report it to the Inspección de Trabajo (Labour Inspectorate) and claim damages.
- The system is compulsory: certific@2 within the TGSS's Sistema RED (not the citizen's Cl@ve PIN).
