Legal basis and things to bear in mind
- Legal age in 2026 (transitional provision 7.ª LGSS): 66 years and 10 months if you have less than 38 years and 3 months of contributions, or 65 years if you have 38 years and 3 months or more. In 2027, the scale reaches its limit: 67 years, or 65 years with 38 years and 6 months of contributions.
- Base reguladora (regulatory base): since 1 January 2026 TWO calculations coexist and the INSS automatically applies the more favourable one, and will do so until 2040. The new one, from transitional provision 40.ª LGSS, divides by 352,33 the sum of the 302 highest contribution bases of the 304 months before the month prior to the qualifying event: the two worst are discarded. The old one, still alive through transitional provision 4.ª.7, is the last 300 months divided by 350, with no discards. The new scale rises every year until 2037. If you have months without contributions, they are filled with minimum bases (integration of gaps).
- Cap on pensions arising in 2026: €3,359.60 a month, €47,034.40 a year (art. 3.1 of Real Decreto 241/2026). The amount is updated every year, so if your calculation comes close to the cap we will confirm the figure applicable to your effective date before submitting.
- The reduction coefficient for early retirement is DEFINITIVE: it is not recovered upon reaching the legal age. And it is not a percentage per month: arts. 207.2 and 208.2 LGSS set out two tables with four contribution brackets and one row per month of anticipation. Retiring two years early with less than 38 years and 6 months of contributions costs 21% of the pension under the voluntary route; with 44 years and 6 months or more, 13%. Contributing longer does not only raise the pension: it makes retiring early cheaper.
- Active retirement: Royal Decree-Law 11/2024 changed the rules with effect from 1 April 2025. The percentage of pension compatible with work is no longer a fixed 50%: it grows the longer you delay your retirement beyond the ordinary age and increases if you are self-employed with at least one hired worker. Anyone who was already in active retirement before that date retains their previous regime. We calculate your specific percentage with your details.
