Which documents do you need?

- •Libro de familia (family record book) or, failing that, a marriage certificate.
- •Certification from the Registro Civil (Civil Registry) showing the marital status (marriage, separation, divorce).
- •If a pareja de hecho (civil partner): certificate from the Registro de Parejas de Hecho (civil partnership register) with the registration date and a historical empadronamiento (municipal registration) certificate proving >=5 years of cohabitation.
- •If an ex-spouse: divorce judgment with the recognised pensión compensatoria (compensatory pension) or, in the case of gender violence, a final judgment or protection order.
- •Document proving that the deceased had NOT entered into a new marriage.
- •Work-life record (vida laboral) of the deceased (if they were not already a pensioner).
- •Certificado de últimas voluntades (certificate of last wills).
Legal basis and things to bear in mind
- Resolution deadline: 90 calendar days (art. 230 TRLGSS). Silencio negativo (deemed refusal by administrative silence): once the deadline passes it is deemed refused and opens the prior claim route.
- Qualifying contributions: 500 days contributed in the 5 years before the death, or 15 years over the entire working life. AT/EP (workplace accident/occupational illness) require no qualifying period. If the deceased was already a pensioner, the qualifying period is deemed fulfilled.
- Pareja de hecho (civil partner): in addition to the 5 years of established cohabitation, requires registration in a Registry or a public document >=2 years before the death, and the beneficiary's income being below 50 % of the shared income.
- Concurrence: if an ex-spouse with a pensión compensatoria (compensatory pension) and a current spouse or civil partner coincide, the pension is shared in proportion to the time of cohabitation, guaranteeing 40 % to the current one.
- Compatibility: the pension is compatible with any earned income and with your own retirement or IP (permanent disability) pension (concurrence limits apply).
