Legal basis and things to bear in mind

  • Framework: arts. 205-209 RDLeg 8/2015 LGSS, RDLey 2/2023, the 7th Transitional Provision of the LGSS and Ley 21/2021 (uprating).
  • Ordinary retirement age in 2026: 65 with 38 years and 3 months of contributions, or 66 years and 8 months with less. It rises to 67 from 2027 if you have less.
  • VOLUNTARY (art. 208): up to 2 years early, at least 35 years of contributions, 2 of them within the last 15, and a pension above the minimum.
  • INVOLUNTARY (art. 207): up to 4 years early, at least 33 years of contributions, 2 of them within the last 15, 6 months registered as a jobseeker, and a cause not attributable to you.
  • REDUCTION COEFFICIENTS (RDLey 2/2023): a monthly table, roughly 3-21% for each month brought forward, depending on your years of contributions. The more years, the smaller the reduction.
  • Calculation: base reguladora (the average of the last 25 years) multiplied by the percentage applied to it, multiplied by (1 minus the reduction).
  • Maximum cap in 2026: around 3.267 €/month (14 payments).
  • PERMANENT: the coefficient applies for life.
  • Compatible options: active retirement (art. 214, available only for ordinary retirement), flexible retirement, and partial retirement with a relief contract (art. 215).
  • Deferral (art. 210.2 LGSS): 4% a year, or an alternative supplement, if you put off retirement beyond the ordinary age.
  • Procedure: apply 3 months in advance at sede.seg-social.gob.es. A decision within 90 days; no reply means the application is refused.
