Legal basis and things to bear in mind

  • This is the natural continuation of the reclamación previa: if the SEPE rejects it or fails to reply within 45 days, this claim is the only route left (art. 71.6 LRJS).
  • 30-day deadline subject to EXPIRY. It is not interrupted by filing another document with the SEPE: if it runs out, the right is lost even if you were correct.
  • A procurador is not mandatory in employment proceedings (art. 18.1 LRJS), and legal representation by a lawyer is optional at first instance (art. 21.1 LRJS). We provide it anyway, and this is recorded in the claim (art. 21.2 LRJS).
  • You are EXEMPT from the court tasa as an individual (art. 4.2.a of Ley 10/2012). There is none to advance.
  • If the SEPE is demanding repayment, we ask in the same claim for the repayment to be suspended while the court decides.
