Which documents do you need?

  • Medical leave report (parte de baja médica) issued by your primary care doctor or by the mutua (in the case of work-related accidents or occupational diseases).
  • If work-related accident or occupational disease: work-related accident report from the company or equivalent documentation.
  • Employee: the company will send the report to the INSS via the Sistema RED.

Legal basis and things to bear in mind

  • Minimum contribution: common illness requires 180 days of contributions in the last 5 years. Work-related accidents, occupational diseases and non-work-related accidents do not require prior contributions.
  • Common illness / non-work-related accident: days 1-3 are unpaid (unless covered by a collective agreement). Days 4-20: 60 % of the BR. Day 21 onwards: 75 % of the BR.
  • Work-related accident / occupational disease: payment starts from the day following the triggering event at 75 % of the BR.
  • Maximum legal duration: 365 days + 180 days extension (prórroga) = 545 days. After this is exhausted, a permanent disability case file is opened.
  • As a self-employed worker in the RETA, temporary disability coverage has been compulsory since 2008. For work-related accidents and occupational diseases it is voluntary but recommended.
  • The medical leave report (parte de baja), confirmation reports (every 7-14 days) and the medical discharge report (parte de alta) are issued by the doctor. The company must communicate them to the INSS within 3 days via the Sistema RED.
