Which documents do you need?

- •If AT/EP: work accident report from the company or equivalent documentation.
- •Employed worker: the company will send the note to the INSS via the Sistema RED.
Legal basis and things to bear in mind
- Minimum contribution: common illness requires 180 days over the last 5 years. AT, EP and ANL do not require prior contributions.
- EC/ANL: days 1-3 unpaid (unless a collective agreement covers them). Days 4-20: 60 % of the regulatory base. Day 21+: 75 % of the regulatory base.
- AT/EP: payment from the day after the triggering event at 75 % of the regulatory base.
- Maximum legal duration: 365 days + 180 extension = 545 days. Once exhausted, a permanent incapacity file is opened.
- As a self-employed worker in RETA, IT (temporary incapacity) cover has been compulsory since 2008. For AT/EP it is voluntary but advisable.
- The sick-leave note, the confirmation notes (every 7-14 days) and the discharge note are issued by the doctor. The company reports them to the INSS within 3 days via the Sistema RED.
