Legal basis and things to bear in mind
- Legal deadline for the INSS to resolve: 135 calendar days (art. 6 RD 1300/1995). If it passes without an express decision, silencio NEGATIVO (deemed refusal by administrative silence). This opens the way to a prior claim (reclamación previa, 30 days) and a claim before the Juzgado Social (Social Court).
- Minimum qualifying period: AT/EP require no qualifying period. EC and ANL require 1/4 of the period between the age of 20 and the date of the causing event (minimum 5 years) or, if you are under 31, half of the period between 16 and that date. Supplementary qualifying period: 1/5 of the required period within the last 10 years.
- IP Absoluta (absolute disability) and Gran Invalidez (major disability) are EXEMPT from IRPF (income tax) (art. 7.f LIRPF). IP Total (total disability) is taxed as employment income and is compatible with work in another profession.
- If you do not reach contributory IP due to the qualifying period, we advise you towards the Pensión No Contributiva de Invalidez (non-contributory disability pension, PNC, managed by IMSERSO/regional governments, with economic requirements).
- The procedure always includes an assessment by the EVI (Equipo de Valoración de Incapacidades, Disability Assessment Team). Bring ALL your medical reports in hand on the day of the appointment.
