  • Updated Vida laboral (work history report).
  • Company certificate with the last contribution base (general regime only).

Legal basis and things to bear in mind

  • Legal deadline for the INSS to resolve: 135 calendar days (art. 6 RD 1300/1995). If this passes without an express resolution, silencio administrativo (deemed refusal by administrative silence) applies. This opens the way to a reclamación previa (administrative appeal) within 30 days and a lawsuit in the Social Court.
  • Minimum contribution period: AT/EP do not require a contribution period. EC and ANL require 1/4 of the period between age 20 and the date of the triggering event (minimum 5 years) or, if you are under 31 years old, half of the period between age 16 and that date. Supplementary contribution period: 1/5 of the required period must be within the last 10 years.
  • IP Absoluta and Gran Invalidez are EXEMPT from IRPF (personal income tax) (art. 7.f LIRPF). IP Total is taxed as employment income and is compatible with working in a different profession.
  • If you do not qualify for a contributory IP due to lack of contributions, we will guide you towards a Pensión No Contributiva de Invalidez (PNC, managed by IMSERSO/CCAA, subject to financial means requirements).
  • The procedure always includes an assessment by the EVI (Equipo de Valoración de Incapacidades). Bring ALL your medical reports in hand on the day of your appointment.
